Filing

Filers in cases assigned to ECF must file petitions, motions, briefs, and other required documents electronically, subject to the order's exceptions and exceptional technical circumstances.

“Except as expressly provided and in exceptional circumstances preventing an E-Filer from filing electronically, all petitions, motions, memoranda of law, or other pleadings and documents required to be filed with the court after September 30, 2005 in connection with a case assigned to ECF shall be electronically filed.”

An ECF filer must retain the paper original of an electronically filed document signed by someone else until four years after all appeal periods expire.

“Documents that are electronically filed and require original signatures other than that of the E-Filer, e.g, affidavits, declarations, must be maintained in paper form by the E-Filer until 4 years after all time periods for appeals expire.”

In the participating prisoner electronic filing program, the prisoner must keep the paper original after facility staff scan and submit it, and produce it if the court orders.

“The prisoner shall keep the original document and produce it at a later time, if ordered to do so by the Court.”

A non-prisoner party in the prisoner electronic filing program must mail the prisoner a copy of each document filed on that party's behalf.

“Defendants and any other non-prisoner party shall mail to the prisoner, via the United States Postal Service, a copy of any document filed on their behalf.”
