MISSISSIPPI COMPREHENSIVE BILL OF SALE PACK

This comprehensive Bill of Sale Pack provides templates for transferring ownership of various types of property under Mississippi law. Select the appropriate form based on the property being transferred.

IMPORTANT: Mississippi vehicle registration and titling is administered by the Mississippi Department of Revenue (DOR) through county Tax Collector offices. Watercraft registration is administered by the Mississippi Department of Wildlife, Fisheries, and Parks (MDWFP). Requirements and fees are subject to change. Verify current requirements with the applicable agency before completing any transfer.

KEY MISSISSIPPI RULES: Buyer must transfer title within 7 days of purchase. The vehicle tax rate is 5% of the purchase price. Mississippi does NOT require safety or emissions inspections. Notarization is recommended for all transfers and is required for boat registration applications.

For gift transfers or transfers between family members, an Affidavit of Relationship must be provided. Trade-in allowances may be deducted from the purchase price for tax calculation purposes.

Mississippi's Motor Vehicle Warranty Enforcement Act (Lemon Law) applies to NEW motor vehicles purchased in Mississippi that do not conform to all applicable express warranties. The law provides that if a new vehicle develops a nonconformity during the express warranty term or within one year of original delivery (whichever expires earlier), the manufacturer or its agent must make necessary repairs to conform the vehicle to the express warranty. If the manufacturer cannot bring the vehicle into conformity after a reasonable number of attempts, the consumer may be entitled to: (a) a replacement vehicle of comparable value acceptable to the consumer, or (b) a full refund of the purchase price including all reasonably incurred collateral charges (dealer preparation, undercoating, transportation, towing, replacement rental, and title charges), less a reasonable allowance for the consumer's use. A "reasonable number of attempts" is presumed when the same nonconformity has been subject to repair 3 or more times, or the vehicle has been out of service for 15 or more business days. This law does NOT apply to used vehicles sold in private-party transactions.

MISSISSIPPI-SPECIFIC CONSIDERATIONS

Flood Damage: Mississippi is susceptible to hurricanes, tropical storms, and river flooding. Buyers should exercise particular caution when purchasing vehicles in Mississippi, especially in coastal counties (Harrison, Hancock, Jackson). Request a vehicle history report (e.g., CARFAX, AutoCheck) and have the vehicle inspected by a qualified mechanic. Under Miss. Code Ann. § 63-21-35, vehicles declared a total loss due to flood damage must carry a salvage brand on the title.

No Inspection Program: Because Mississippi does not have a safety or emissions inspection program, the buyer bears full responsibility for ensuring the vehicle is mechanically sound and roadworthy. This makes a pre-purchase inspection by a qualified mechanic especially important.

Gulf Coast Boats: Watercraft previously used in Gulf Coast saltwater environments may have accelerated corrosion and wear. Buyers should request information about where the vessel was primarily stored and used, and should have a marine survey conducted for vessels of significant value.

About This Template

A contract is a written record of what two or more parties agreed to and what happens if someone does not follow through. Clear language, defined terms, and clean signature blocks keep disputes small and enforceable. The most common mistakes in contracts come from vague promises, missing details about timing or payment, and skipping standard protective clauses like governing law and dispute resolution.

Important Notice

This template is provided for informational purposes. It is not legal advice. We recommend having an attorney review any legal document before signing, especially for high-value or complex matters.
