Tax Note: New Mexico imposes a Gross Receipts Tax (GRT) rather than a traditional sales tax. The rate varies by location (typically between 5.00% and 9.4375%). NEW MEXICO MOTOR VEHICLE EXCISE TAX NOTICE: New Mexico imposes a 4% Motor Vehicle Excise Tax (MVET) on all motor vehicle purchases, including private-party sales. The tax is calculated on the purchase price of the vehicle less any trade-in credit. The MVET is collected by the NM MVD at the time of titling.

IMPORTANT — NADA VALUE RULE: For non-dealer sales, if the declared purchase price is less than 80% of the NADA average trade-in or wholesale value, the MVD will use the NADA value for tax calculation purposes. This prevents underreporting of purchase prices.

NEW MEXICO LEMON LAW NOTICES:

New Motor Vehicle Quality Assurance Act (NMSA 1978 §§ 57-16A-1 through 57-16A-9):
This law applies to NEW motor vehicles. If a new motor vehicle does not conform to all applicable express warranties and the consumer reports the nonconformity to the manufacturer, its agent, or authorized dealer during the express warranty term or during the first year following original delivery (whichever is earlier), the manufacturer must make necessary repairs. If after a reasonable number of attempts (four or more repair attempts for the same defect, or 30+ cumulative business days out of service) the vehicle still does not conform, the manufacturer must replace the vehicle or provide a full refund. The consumer must provide prior direct written notification to the manufacturer before the presumption of reasonable repair attempts applies. This law does NOT apply to used vehicles sold in private-party transactions.

Used Motor Vehicle Implied Warranty (NMSA 1978 § 57-16A-3.1):
A used motor vehicle dealer shall not exclude, modify, or disclaim the implied warranty of merchantability (NMSA 1978 § 55-2-314) or limit remedies for breach of the warranty before midnight of the 15th calendar day after delivery or until the vehicle is driven 500 miles after delivery, whichever is earlier. An implied warranty of merchantability is met if the vehicle functions substantially free of a defect that significantly limits its use for ordinary transportation. The consumer shall pay one-half of the cost of the first two repairs necessary to bring the vehicle into compliance. This warranty applies only to dealer sales, not private-party transactions.

BUYER'S OBLIGATIONS:

Per New Mexico law (NMSA 1978 § 66-3-1 et seq.), Buyer must:

CRITICAL — LATE TITLING PENALTY:

If a New Mexico resident fails to apply for a certificate of title within 90 days of accepting transfer of a vehicle, a penalty of 50% of the Motor Vehicle Excise Tax is imposed. This effectively increases the tax from 4% to 6% of the purchase price.

NEW MEXICO DOES NOT REQUIRE A SAFETY INSPECTION:

New Mexico does not require a general safety inspection for passenger vehicles. There is no statewide safety inspection program.

EMISSIONS INSPECTION REQUIREMENTS:

Emissions testing is required only in Bernalillo County (Albuquerque metropolitan area):

  • All 1983 and newer motor vehicles up to 10,000 lbs. GVW must pass an emissions test
  • Required every two years and at every change of ownership
  • Applies to vehicles registered in Bernalillo County or commuting there for 60 or more days per year
  • Testing is performed at over 130 Air Care Stations throughout the Albuquerque/Bernalillo County area
  • Typical cost: approximately $25 plus tax (set by individual stations)
  • One free retest within 90 days of a failed test at the Vehicle Pollution Management Division headquarters

Exempt from emissions testing:

  • Dedicated electric vehicles
  • Diesel-powered vehicles
  • Vehicles older than 35 model years
  • Farm equipment
  • Competition-only vehicles
  • Vehicles over 10,000 lbs. GVW
  • New vehicles owned by the original purchaser for under four model years
  • Vehicles registered outside Bernalillo County (unless commuting 60+ days/year)

SECTION 9: NEW MEXICO WATERCRAFT REQUIREMENTS

IMPORTANT NEW MEXICO REQUIREMENTS:

Per NMSA 1978 § 66-3-901 et seq. and NM MVD / NM Energy, Minerals and Natural Resources Department (EMNRD) State Parks Division regulations:

  1. All motorized and sail-powered vessels 10 feet or longer in length must be titled with the NM Motor Vehicle Division.

  2. All mechanically propelled vessels of any length must be registered with the NM MVD.

  3. Motorized vessels less than 10 feet in length must be registered but are not required to be titled.

  4. Title application must be submitted to the MVD within 30 days of sale. A $20 late fee applies after 30 days.

  5. Vessel registration is administered by the NM MVD. Registration numbers must be displayed on both sides of the bow.

  6. The NM Energy, Minerals and Natural Resources Department (EMNRD) State Parks Division administers boating regulations and boater education requirements.

  7. All operators born on or after January 1, 1989, must hold a valid New Mexico Boating Safety Education Certificate.

New Mexico does NOT require a general safety inspection for passenger vehicles. There is no statewide or county-level safety inspection program.

Emissions Inspection (Bernalillo County Only):

  • Required for all 1983 and newer motor vehicles up to 10,000 lbs. GVW
  • Required every two years and at change of ownership
  • Applies only to vehicles registered in Bernalillo County or commuting there 60+ days per year
