North Dakota Motor Vehicle Excise Tax: North Dakota imposes a 5% Motor Vehicle Excise Tax on the purchase price of all motor vehicles at the time of title transfer, pursuant to N.D.C.C. § 57-40.3. Key points:
- The 5% excise tax applies to all private-party and dealer sales.
- The tax is based on the purchase price or the fair market value (NADA retail value), whichever is greater, as determined by the NDDOT.
- Trade-in values reduce the taxable amount.
- Gift transfers between certain family members may qualify for a reduced rate or exemption. A gift affidavit is required.
- The excise tax is paid to the NDDOT Motor Vehicle Division or the county treasurer's office at the time of title transfer.
- There is no additional state sales tax on motor vehicles (the excise tax replaces the general sales tax for vehicles).

NORTH DAKOTA LEMON LAW NOTICE (N.D.C.C. §§ 51-07-16 through 51-07-22):
North Dakota's Lemon Law applies to new passenger motor vehicles normally used for personal, family, or household purposes that are purchased or leased in North Dakota. The law requires manufacturers to repair nonconformities that substantially impair the use, market value, or safety of the vehicle during the express warranty term or within one year following the date of original delivery to the consumer, whichever is earlier. If the manufacturer is unable to conform the vehicle to the warranty after a reasonable number of repair attempts (three or more attempts for the same nonconformity, or the vehicle is out of service for a cumulative total of 30 or more business days during the express warranty term or one year following original delivery, whichever is earlier), the consumer may be entitled to a replacement vehicle or refund. The consumer must first notify the manufacturer in writing and allow a final repair attempt. This law does NOT apply to used vehicles sold in private-party transactions.
North Dakota Lemon Law Remedies: If the manufacturer fails to conform the vehicle after reasonable repair attempts, the consumer may request:
- A replacement vehicle of comparable value, OR
- A full refund of the purchase price, including all collateral charges (minus a reasonable allowance for the consumer's use of the vehicle)

SECTION 9: NORTH DAKOTA WATERCRAFT REQUIREMENTS
IMPORTANT NORTH DAKOTA REQUIREMENTS:
Per N.D.C.C. § 20.1-13 and North Dakota Game and Fish Department regulations:

No Titling: North Dakota does NOT title watercraft. The state issues registrations only. A bill of sale is the primary proof of ownership transfer. Buyers should retain this Bill of Sale permanently.

Registration Required: All motorized watercraft operating on North Dakota waters must be registered with the North Dakota Game and Fish Department. Canoes and non-motorized vessels are also required to be registered.

Registration Period: Watercraft registrations are valid for a three-year period (currently January 1, 2026 through December 31, 2028). Registration is prorated based on time remaining in the registration period.

Transfer Process: When purchasing a boat from a private individual, the buyer must complete the registration online at the North Dakota Game and Fish Department website or by mail. The seller should provide the current registration card or title (if from another state) and a bill of sale.

NORTH DAKOTA INSPECTION REQUIREMENTS
Safety Inspection:
North Dakota does NOT have a mandatory safety inspection program for private-party vehicle sales or for any vehicles. There is no statewide periodic vehicle inspection requirement. Vehicles are not required to pass a safety inspection before title transfer, registration, or at any other time.
Emissions Inspection:
North Dakota does NOT have a vehicle emissions testing program. There is no statewide or county-level emissions inspection requirement.
Note: While North Dakota does not require inspections, law enforcement may issue citations for vehicles that are unsafe or do not meet equipment standards under N.D.C.C. Title 39. NORTH DAKOTA-SPECIFIC CONSIDERATIONS
Notarization is Required for the Seller: North Dakota requires the Seller's signature on Form SFN 2888 (Seller's Certificate and Vehicle Bill of Sale) to be notarized. This is a strict requirement. Plan accordingly and have a Notary Public available when completing the sale. Many banks, UPS stores, and courthouse offices provide notary services.
Plates Stay with the Owner: In North Dakota, license plates remain with the vehicle owner, not the vehicle. Sellers must remove their plates before delivering the vehicle. Buyers must obtain new plates or transfer plates from another vehicle they own.
No Boat Titling: North Dakota is one of the states that does not title watercraft. Only registration is required through the Game and Fish Department. This means the bill of sale is the most important document for proving watercraft ownership. Buyers should always obtain a detailed, signed (and preferably notarized) bill of sale when purchasing a boat in North Dakota.
Hail Damage: North Dakota's climate makes hail damage a common occurrence. Buyers should carefully inspect vehicles for hail damage, and sellers should disclose any hail damage history. Vehicles with significant hail damage may receive a branded title.
Winter Considerations: North Dakota's extreme cold climate can affect vehicle condition. Buyers should inspect for cold-weather-related issues including battery condition, block heater functionality, rust from road salt, and overall winter wear. Block heaters are common and may be included in the sale.
Agricultural Vehicles: North Dakota has special provisions for agricultural vehicles and farm equipment. Certain agricultural vehicles may have different registration requirements or exemptions. Contact the NDDOT Motor Vehicle Division for agricultural vehicle-specific guidance.
