Kansas Comprehensive Bill of Sale Pack
KANSAS COMPREHENSIVE BILL OF SALE PACK
This comprehensive Bill of Sale Pack provides templates for transferring ownership of various types of property under Kansas law. Select the appropriate form based on the property being transferred.
IMPORTANT: Kansas vehicle titling and registration is administered at the county level through the County Treasurer's Motor Vehicle Office. The official Bill of Sale is Form TR-312, the Title Application is Form TR-212a, and the Seller's Notification of Sale is Form TR-216. This document supplements but does not replace those official forms. Verify current requirements with your county treasurer's office or at ksrevenue.gov.

Kansas Practice Note: Under K.S.A. 84-2-316, to effectively disclaim the implied warranty of merchantability, the disclaimer must mention "merchantability" and, if in writing, must be conspicuous. To disclaim the implied warranty of fitness for a particular purpose, the disclaimer must be in writing and conspicuous. An "as-is" or "with all faults" disclaimer is generally effective to exclude all implied warranties under Kansas law when the buyer has examined the goods or had the opportunity to examine them and refused. The language must be conspicuous — meaning a reasonable person against whom it is to operate ought to have noticed it (e.g., all capitals, bold, contrasting type).

☐ The odometer reading is NOT the actual mileage. WARNING — ODOMETER DISCREPANCY.
Seller certifies that to the best of Seller's knowledge the above odometer statement is true and correct. Federal law (49 U.S.C. § 32703) and Kansas law prohibit the disconnection, resetting, or alteration of a motor vehicle odometer with intent to change the number of miles indicated. Violation is a federal criminal offense and may also constitute fraud under Kansas law (K.S.A. 21-5824 — Tampering with odometer).
Kansas Note: The odometer disclosure must be recorded on the Kansas Certificate of Title at the time of transfer. If the title does not have sufficient space, the odometer reading should also be recorded on the Bill of Sale (Form TR-312) or a separate Odometer Disclosure Statement.

Tax Note: Kansas imposes a 6.5% state sales tax on vehicle purchases plus applicable local sales taxes (city and county). The combined rate varies by location and can range from 6.5% to approximately 11.5%. Sales tax on private-party vehicle purchases is collected by the county treasurer at the time of title transfer. Kansas allows a trade-in credit — the taxable amount is reduced by the trade-in allowance if the trade-in occurs as part of the same transaction with a dealer (private-party trade-ins may not qualify).
Sales Tax Calculation:
Purchase Price: $[________________________________]
Less Trade-In Allowance (if applicable): $[________________________________]
Taxable Amount: $[________________________________]
State Sales Tax (6.5%): $[________________________________]
Local Sales Tax ([____]%): $[________________________________]

Important: The applicable combined sales tax rate is determined by the location where the vehicle will be garaged/primarily kept, not where the sale takes place. Contact your county treasurer's office for the exact combined rate for your address.
SECTION 6: WARRANTY STATUS
Select ONE:
☐ "AS-IS" SALE — NO WARRANTY
THIS VEHICLE IS SOLD "AS-IS, WHERE-IS, WITH ALL FAULTS." THE SELLER MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE PURSUANT TO K.S.A. 84-2-316.
BUYER ACKNOWLEDGES HAVING THE OPPORTUNITY TO INSPECT THE VEHICLE OR HAVE IT INSPECTED BY A MECHANIC OF BUYER'S CHOICE PRIOR TO PURCHASE. BUYER ACCEPTS THE VEHICLE IN ITS PRESENT CONDITION AND ASSUMES ALL RISK OF DEFECTS, WHETHER KNOWN OR UNKNOWN.
KANSAS LEMON LAW NOTICE (K.S.A. §§ 50-645, 50-646, 50-659):
Kansas's New Vehicle Warranty Act (Lemon Law) applies to new motor vehicles sold or leased in Kansas with a gross vehicle weight rating of 12,000 pounds or less. The law covers nonconformities reported to the manufacturer, its agent, or authorized dealer during the term of the express warranty or within one year following the original delivery, whichever is earlier. If the manufacturer fails to repair a nonconformity after a reasonable number of attempts (4 repair attempts for the same defect, or the vehicle is out of service for 30 or more calendar days), the buyer may be entitled to a replacement vehicle or refund. This law does NOT apply to used vehicles sold in private-party transactions. K.S.A. § 50-659 provides for attorney's fees for a prevailing consumer.

Kansas Practice Note: Under K.S.A. 8-135(c), when a lien is satisfied, the lienholder must release the lien and deliver the title to the owner. If the title is held by an electronic lien system (ELT), the lienholder must transmit the release electronically. Both buyer and seller should coordinate with the lienholder to ensure proper title transfer.
SECTION 8: SELLER REPRESENTATIONS
Seller represents and warrants:
☐ Seller is the registered and titled owner of the vehicle and has full authority to sell and transfer title.
☐ The title is genuine and has not been altered, tampered with, or forged.

☐ The vehicle has not been reported as stolen and is not subject to any seizure or forfeiture action.
☐ The vehicle is not subject to any pending legal action, judgment, or claim of which Seller is aware.
SECTION 9: KANSAS COUNTY TREASURER REQUIREMENTS

-
☐ Deliver the assigned title to Buyer at time of sale
-
☐ Complete and sign the Bill of Sale (Form TR-312) or this equivalent document

Kansas Note: Kansas does not require notarization of a bill of sale for motor vehicles. The properly assigned title is the primary document for title transfer at the county treasurer's office. However, notarization is recommended for high-value transactions.
PART THREE: WATERCRAFT/BOAT BILL OF SALE
STATE OF KANSAS
COUNTY OF [________________________________]
WATERCRAFT, VESSEL, AND OUTBOARD MOTOR BILL OF SALE
Kansas does NOT title watercraft. Boats are registered (not titled) through the Kansas Department of Wildlife and Parks (KDWP). This Bill of Sale serves as the primary proof of ownership transfer for watercraft in Kansas.
NOTICE: Because Kansas does not issue titles for watercraft, this Bill of Sale is the most important document evidencing the transfer of ownership. Both parties should retain copies. The Buyer must register the watercraft with KDWP. Registration is valid for 3 years.

IMPORTANT KANSAS REQUIREMENTS:
Per K.S.A. 32-1101 et seq. and Kansas Department of Wildlife and Parks (KDWP) regulations:
-
No Title System: Kansas does NOT title watercraft. There is no certificate of title issued for boats in Kansas. This Bill of Sale, along with the registration certificate, serves as documentation of ownership.
-
Registration Required: All vessels powered by motor (gasoline, diesel, or electric) or sail must be registered and numbered with KDWP. Non-motorized vessels (canoes, kayaks, rowboats without motors) are generally exempt from registration.
-
Registration Fee: The registration fee for ALL boats is $42.50 for a 3-year period, regardless of vessel size.
-
Registration Duration: Kansas boat registrations are valid for 3 years from the date of registration.
-
Registration Number Display: The registration number (KS prefix) must be displayed on both sides of the bow in block letters at least 3 inches high, reading left to right.
-
Certificate of Number: The registration certificate must be carried aboard the vessel at all times while operating on Kansas waters.
-
Registration Transfer: When a vessel is sold, the Buyer must obtain a new registration in their name. The Seller's registration does NOT transfer to the Buyer.
-
Out-of-State Vessels: Boats registered in other states may be operated in Kansas for up to 60 consecutive days. After 60 days, Kansas registration is required.
-
Boating Safety Education: Kansas recommends but does not require boating safety education for all operators. However, persons born on or after January 1, 1989, who operate a vessel with more than 15 HP must have a boating safety education certificate.
-
KDWP Enforcement: The Kansas Department of Wildlife and Parks, along with county law enforcement and state park rangers, enforces boating regulations on Kansas waters.

Registrations may be obtained or renewed:

About This Template
A contract is a written record of what two or more parties agreed to and what happens if someone does not follow through. Clear language, defined terms, and clean signature blocks keep disputes small and enforceable. The most common mistakes in contracts come from vague promises, missing details about timing or payment, and skipping standard protective clauses like governing law and dispute resolution.
Important Notice
This template is provided for informational purposes. It is not legal advice. We recommend having an attorney review any legal document before signing, especially for high-value or complex matters.
