IMPORTANT: Georgia vehicle registration and titling is administered at the county level through the county tax commissioner's office. The primary form for vehicle title application is Form MV-1 (Motor Vehicle Title Application). Georgia imposes a Title Ad Valorem Tax (TAVT) at 7.0% of the fair market value of the vehicle in lieu of sales tax and annual ad valorem tax (O.C.G.A. Section 48-5C-1). GEORGIA TITLE AD VALOREM TAX (TAVT) INFORMATION:
Georgia replaced traditional sales tax and annual ad valorem tax on vehicles with the Title Ad Valorem Tax (TAVT) effective March 1, 2013. TAVT is a one-time tax paid at the time of title transfer.

Georgia's Motor Vehicle Warranty Rights Act (Lemon Law) applies to NEW motor vehicles that develop nonconformities that substantially impair the use, value, or safety of the vehicle. Georgia does NOT require periodic safety inspections for private passenger vehicles. There is no safety inspection requirement for vehicle sales or registration.

Emissions Testing Details:
- Required at initial registration and at annual registration renewal for vehicles registered in the 13 designated counties
- Gasoline-powered vehicles weighing 8,500 lbs GVWR or less and less than 25 model years old must be tested
- New vehicles are exempt for their three most recent model years (for 2026 registration: 2024, 2025, and 2026 model years are exempt)
- Testing is performed at Georgia's Clean Air Force inspection stations throughout the 13 counties
- Diesel vehicles, electric vehicles, motorcycles, and vehicles over 8,500 lbs GVWR are generally exempt
- A valid emissions inspection certificate is required before the county tax commissioner will process registration

SECTION 9: GEORGIA WATERCRAFT REQUIREMENTS

Registration: All motorized vessels operated on Georgia waters must be registered with the Georgia Department of Natural Resources, Wildlife Resources Division. Non-motorized vessels (canoes, kayaks, paddle boards) used on non-federal waters are generally exempt.

eTitle System: Georgia uses an electronic title (eTitle) system for vessels. Once registration is finalized, the Boat Registration and Verification Record serves as the eTitle. There is no separate paper title issued unless specifically requested. If the Boat Registration and Verification Record shows "eTitled," that document IS the official title record.

Registration Period: Georgia vessel registrations are valid for 3 years and expire on the last day of the owner's birth month in the third year.

Transfer Reporting: Boat owners must report the sale or transfer of their vessel within 15 days. This may be done online at GoOutdoorsGeorgia.com, by phone at 1-800-366-2661, or in writing using the Certified True Bill of Sale for Vessels.

Registration Numbers: Georgia registration numbers (GA prefix) must be displayed on both sides of the bow in block letters at least 3 inches high.

GEORGIA INSPECTION REQUIREMENTS
Safety Inspection:
Georgia does NOT require periodic safety inspections for private passenger vehicles. There is no safety inspection requirement for vehicle sales, registration, or renewal.
Emissions Inspection:
Emissions testing is required ONLY in the following 13 metro Atlanta counties: Cherokee, Clayton, Cobb, Coweta, DeKalb, Douglas, Fayette, Forsyth, Fulton, Gwinnett, Henry, Paulding, and Rockdale.
- Testing is required at initial registration and at annual registration renewal
- Gasoline-powered vehicles weighing 8,500 lbs GVWR or less and less than 25 model years old must be tested
- New vehicles are exempt for their three most recent model years
- Testing is performed at Georgia's Clean Air Force inspection stations
- A valid emissions certificate is required before the county tax commissioner will process registration in these counties

The sale of goods (including vehicles, watercraft, and personal property) in Georgia is governed by the Uniform Commercial Code as adopted in O.C.G.A. Title 11, Article 2. Key provisions include:
- O.C.G.A. Section 11-2-312: Warranty of title — Seller warrants good title and rightful transfer, free from security interests unknown to buyer.
- O.C.G.A. Section 11-2-313: Express warranties — Created by affirmations of fact, descriptions, or samples that become part of the basis of the bargain.
- O.C.G.A. Section 11-2-314: Implied warranty of merchantability — Goods must be fit for ordinary purposes, pass without objection in the trade, and conform to label descriptions.
- O.C.G.A. Section 11-2-315: Implied warranty of fitness for particular purpose — If seller knows buyer's particular purpose and buyer relies on seller's expertise.

GEORGIA eTITLE SYSTEM

- Motor Vehicles: Georgia transitioned to eTitles for motor vehicles. If a vehicle has an eTitle, the owner must request a paper title from the county tax commissioner before selling the vehicle (unless the transfer is processed entirely through the eTitle system).
- Vessels: Georgia uses eTitles for all registered vessels. The Boat Registration and Verification Record serves as the eTitle. If this document shows "eTitled," it is the only title record that exists.
- Lien Releases: Lienholders can release liens electronically through the eTitle system, which may expedite the title transfer process.
- Paper Title Requests: If a paper title is needed for any reason (out-of-state transfer, etc.), the owner must contact the county tax commissioner (vehicles) or DNR (vessels) to request conversion.
