Indiana Comprehensive Bill of Sale Pack
INDIANA COMPREHENSIVE BILL OF SALE PACK
This comprehensive Bill of Sale Pack provides templates for transferring ownership of various types of property under Indiana law. Select the appropriate form based on the property being transferred.
IMPORTANT: Indiana vehicle and watercraft titling and registration is administered by the Indiana Bureau of Motor Vehicles (BMV). The official Bill of Sale is State Form 44237, and the Title Application is Form 205. This document supplements but does not replace those official forms. Verify current requirements at your local BMV branch or at in.gov/bmv.

SECTION 4: WARRANTY SELECTION
Select ONE of the following warranty options:
☐ OPTION A: "AS-IS" SALE — NO WARRANTY
THIS PROPERTY IS SOLD "AS-IS, WHERE-IS, WITH ALL FAULTS." THE SELLER MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY (IC 26-1-2-314) AND FITNESS FOR A PARTICULAR PURPOSE (IC 26-1-2-315). Indiana Practice Note: Under IC 26-1-2-316, to effectively disclaim the implied warranty of merchantability, the disclaimer must mention "merchantability" and, if in writing, must be conspicuous. To disclaim the implied warranty of fitness for a particular purpose, the disclaimer must be in writing and conspicuous. An "as-is" or "with all faults" disclaimer is generally effective to exclude all implied warranties under Indiana law when the buyer has had an opportunity to inspect the goods. The words must be conspicuous — meaning a reasonable person against whom the disclaimer is to operate ought to have noticed it (e.g., all capitals, bold, or larger type).

Seller certifies that to the best of Seller's knowledge the above odometer statement is true and correct. Federal law (49 U.S.C. § 32703) and Indiana law prohibit the disconnection, resetting, or alteration of a motor vehicle odometer with intent to change the number of miles indicated. Violation is a federal criminal offense and may also constitute fraud under Indiana law.

INDIANA LEMON LAW NOTICE (IC 24-5-13):
Indiana's Motor Vehicle Protection Act (Lemon Law) applies to new motor vehicles that develop nonconformities substantially impairing the use, market value, or safety of the vehicle. The law covers defects reported during the earlier of (a) 18 months from original delivery or (b) 18,000 miles. If the manufacturer fails to repair a nonconformity after a reasonable number of attempts (4 attempts for the same defect, or 30 or more cumulative business days out of service), the buyer may be entitled to a replacement or refund. Indiana Practice Note: Under IC 9-17-5, a lienholder must release the lien and return the title to the owner within 15 business days of satisfaction of the lien. If the title is held by a lienholder, both buyer and seller should coordinate with the lienholder to ensure proper title transfer.

INDIANA INSPECTION REQUIREMENTS
Safety Inspection:
Indiana does NOT require a general safety inspection for motor vehicles. There is no statewide vehicle safety inspection program. Vehicles are not required to pass a safety check before registration or sale.
Emissions Inspection (Lake County and Porter County ONLY):
- Required biennially (every 2 years) for qualifying vehicles
- Applies to vehicles manufactured after 1975 with a GVWR of 9,000 lbs or less
- Even model year vehicles tested in even calendar years; odd model years in odd years
- Vehicles within the 4 most recent model years are exempt
- Diesel, electric, motorcycles, RVs, and pre-1976 vehicles are exempt
- Testing performed at Clean Air Car Check authorized stations
- Cost: Approximately $9.50 per test (subject to change)
- Failure to comply may result in inability to register or renew registration
Legislative Note: Indiana Senate Bill 103 (2025) initiated a phased withdrawal of Lake and Porter Counties from the Metropolitan Chicago Interstate Air Quality Control Region, potentially leading to the eventual phase-out of the emissions testing program. Check current status with the BMV or Clean Air Car Check.

About This Template
A contract is a written record of what two or more parties agreed to and what happens if someone does not follow through. Clear language, defined terms, and clean signature blocks keep disputes small and enforceable. The most common mistakes in contracts come from vague promises, missing details about timing or payment, and skipping standard protective clauses like governing law and dispute resolution.
Important Notice
This template is provided for informational purposes. It is not legal advice. We recommend having an attorney review any legal document before signing, especially for high-value or complex matters.
