VIRGINIA MOTOR VEHICLE SALES AND USE TAX (SUT):

Virginia imposes a Motor Vehicle Sales and Use Tax (SUT) on all vehicle sales and transfers. The tax rate and minimum are as follows:

Virginia's Motor Vehicle Warranty Enforcement Act (Lemon Law) applies to NEW motor vehicles that develop nonconformities that significantly impair the use, market value, or safety of the vehicle during the lemon law rights period (18 months after the date of original delivery to the consumer). IMPORTANT: Virginia REQUIRES an annual safety inspection for ALL vehicles operated on Virginia roads. This is a MANDATORY requirement.

Virginia Safety Inspection:

  • Required annually for ALL motor vehicles, trailers, and semi-trailers operated on Virginia roads
  • Inspections cover brakes, lights, tires, steering, suspension, windshield/glass, mirrors, horn, exhaust system, fuel system, and other safety components
  • Fee: Set by Virginia law (varies; typically $12-$20 for a standard inspection)
  • Must be performed by a Virginia-certified inspection station
  • A valid inspection sticker must be displayed on the windshield
  • New vehicles: First inspection required 12 months after purchase
  • Vehicles with a rejection sticker have 15 days to complete repairs and return for re-inspection

SECTION 9: VIRGINIA WATERCRAFT REQUIREMENTS

IMPORTANT VIRGINIA REQUIREMENTS:

Per Va. Code § 29.1-733 et seq. and Virginia DWR regulations:

  1. Titling: Virginia requires titling for all machinery-propelled watercraft (motorboats, personal watercraft, etc.). Sailboats without motors and non-motorized vessels (canoes, kayaks) do not require titles but must be registered if operated on Virginia waters.

  2. Registration: All motorized watercraft, sailboats, and personal watercraft operated on Virginia waters must be registered with the Virginia DWR or DMV. Non-motorized vessels (canoes, kayaks, paddleboards) that are 18 feet or longer must also be registered.

  3. Transfer Requirements: When purchasing a used watercraft with valid current registration, the buyer may operate the vessel for 30 days from the date of purchase, provided the buyer carries a dated bill of sale and the former owner's valid registration card.

  4. Watercraft Sales and Use Tax: A 2% tax (maximum $2,000) applies to all watercraft purchases. The seller must provide a signed invoice to the buyer. The tax is paid to the Virginia Department of Taxation.

VIRGINIA-SPECIFIC LEGAL NOTES

  1. No Notarization Required for Sales: Virginia does not require notarization for a standard bill of sale or vehicle title transfer. However, notarization IS required for the SUT 3 gift tax exemption form and is recommended for high-value transactions.

  2. Plates Stay with Seller: In Virginia, license plates remain with the seller, not the vehicle. The seller should remove the plates at the time of sale. Plates can be transferred to another vehicle, retained, or surrendered.
