North Carolina Highway Use Tax: North Carolina imposes a 3% Highway Use Tax on the retail value or purchase price of a motor vehicle (whichever is greater) at the time of title transfer, pursuant to N.C.G.S. § 105-187.1 et seq. Key points:
- The Highway Use Tax replaces the traditional sales tax on motor vehicles.
- Maximum Highway Use Tax: $250.00 for certain transfers (private-party casual sales may be subject to a higher cap or no cap depending on the vehicle type — verify current law with NCDMV).
- Trade-in credit: The value of a trade-in vehicle reduces the taxable amount.
- Gift transfers between certain family members may qualify for a reduced rate or exemption. A notarized Affidavit of Gift (Form MVR-317) is required.
- Vehicles transferred from out of state: A maximum tax of $250.00 applies if the vehicle was titled in another state for at least 90 days prior to the NC application.
- The Highway Use Tax is paid to the NCDMV at the time of title transfer.

NORTH CAROLINA LEMON LAW NOTICE (N.C.G.S. § 20-351 et seq.):
North Carolina's New Motor Vehicles Warranties Act (Lemon Law) applies to new passenger motor vehicles, including cars, pickup trucks, motorcycles, and most vans, purchased or leased in North Carolina. The law requires manufacturers to repair nonconformities that substantially impair the use, market value, or safety of the vehicle within the first 24 months or 24,000 miles (whichever comes first). If the manufacturer is unable to conform the vehicle to the warranty after a reasonable number of repair attempts (four or more attempts for the same defect, or the vehicle is out of service for 20 or more cumulative business days during any 12-month period of the warranty), the consumer may be entitled to a replacement vehicle or refund. The consumer must first submit the dispute to the manufacturer's informal dispute settlement procedure (if one exists) before pursuing legal action. Note (2026 Update): The NC Department of Environmental Quality (DEQ) has proposed eliminating emissions testing in all counties except Mecklenburg County, pending EPA approval. This change may take effect in mid-2026. Verify current requirements at the time of your transaction.

NORTH CAROLINA-SPECIFIC CONSIDERATIONS
Notarization is Mandatory for Vehicle Transfers: North Carolina is one of the states that requires notarization of the title assignment for all motor vehicle transfers. Both the seller's and buyer's signatures on the title must be notarized with wet-ink signatures in the presence of a Notary Public. This is a strict requirement that the NCDMV enforces.
