1. Written Contract Required - A written contract is required to claim a lien (delivery slips qualify for suppliers)

2. Residential Projects (NUBARFL): Before filing a lien on residential construction, claimants must file a Notice of Unpaid Balance and Right to File Lien (NUBARFL) within 60 days after last furnishing

3. Commercial Projects: No preliminary notice required, but lien claim must be filed within 90 days of last furnishing

WRITTEN CONTRACT REQUIREMENT

CRITICAL: You must have a written contract to file a lien.
- For suppliers: Delivery slip or order slip signed by debtor qualifies
- No written contract = No lien rights

When Required: Before filing any lien on residential construction property

LIEN CLAIM FILING DEADLINES

SERVICE REQUIREMENTS (N.J.S.A. § 2A:44A-7)

2. Simultaneous registered/certified mail AND ordinary mail, OR
3. Commercial courier AND ordinary mail

Serve on: Owner, contractor, and subcontractor against whom claim is asserted

THIRD-TIER LIEN CLAIMANTS

Third-tier lien claimants (sub to 2nd tier or supplier to 2nd tier) have lien rights but must comply with all requirements.

WHO CAN FILE A LIEN

• Contractors (direct contract with owner)
• Subcontractors
• Suppliers (with written contract/delivery slip)
• Third-tier lien claimants (limited circumstances)

ENFORCEMENT DEADLINE

Lien claim must be enforced by lawsuit within 1 year of the date of last provision of work, services, material, or equipment.
