NEW JERSEY CONSTRUCTION LIEN LAW (CLL):

  1. Written Contract Required - A written contract is required to claim a lien (delivery slips qualify for suppliers)

  2. Residential Projects (NUBARFL): Before filing a lien on residential construction, claimants must file a Notice of Unpaid Balance and Right to File Lien (NUBARFL) within 60 days after last furnishing

  3. Commercial Projects: No preliminary notice required, but lien claim must be filed within 90 days of last furnishing

CRITICAL: You must have a written contract to file a lien.
- For suppliers: Delivery slip or order slip signed by debtor qualifies

THIRD-TIER LIEN CLAIMANTS

Third-tier lien claimants (sub to 2nd tier or supplier to 2nd tier) have lien rights but must comply with all requirements.

  • Suppliers (with written contract/delivery slip)

ENFORCEMENT DEADLINE
