ALABAMA CONSTRUCTION LIEN - LEGAL REQUIREMENTS SUMMARY

TWO TYPES OF LIENS

Full Price Lien:
- Available to: Original/General contractors (automatic); Materialmen (with proper notice)
- Amount: Full contract/invoice amount
- Requirement: Materialmen must give pre-furnishing notice specifying exact materials and prices

Unpaid Balance Lien:
- Available to: Subcontractors, laborers, materialmen without pre-furnishing notice
- Amount: Limited to unpaid balance owed by owner to GC at time of notice
- Requirement: Notice of Intent to Claim Lien before filing lien

PRE-FURNISHING NOTICE (§ 35-11-210)

Who Must Give: Materialmen who want a Full Price Lien

When: BEFORE furnishing any materials

To Whom: Owner (and construction lender)

Requirements:
- Specify exact materials (not general descriptions)
- Specify exact prices

Effect: If no objection from owner, materialman has lien for full price

Who Must Give: Subcontractors, materialmen, laborers claiming Unpaid Balance Lien

When: BEFORE filing the Statement of Lien

To Whom: Owner, general contractor, and construction lender

Content:
- State that a lien is claimed
- Set forth the amount due
- Describe the work performed
- Identify who owes the money

LIEN FILING DEADLINES

WHO CANNOT CLAIM FULL PRICE LIEN

• Subcontractors (even with notice)
• Laborers (even with notice)
• Only materialmen can claim Full Price Lien with proper notice

STRICT COMPLIANCE REQUIRED

Alabama courts strictly enforce mechanics lien statutory requirements. Failure to comply with notice requirements can result in loss of lien rights.
