UTAH PRELIMINARY NOTICE - LEGAL REQUIREMENTS SUMMARY
DEADLINE TO FILE NOTICE
- 20 days after the claimant commences providing construction work on the real property
- Notice must be filed with the State Construction Registry (SCR)
LATE FILING CONSEQUENCES
If filed late, the claimant:
- May still file a preliminary notice after the 20-day deadline
- CANNOT claim a construction lien for work provided before the date that is 5 days after the preliminary notice is filed
- CAN claim a lien for work performed within 5 days prior to filing and all work thereafter
NO EFFECT IF FILED TOO LATE
A preliminary notice has no effect if filed more than 10 days after the filing of a Notice of Completion for the project.
WHO MUST FILE PRELIMINARY NOTICE
- All persons who desire to claim a construction lien must file a preliminary notice
- This includes: subcontractors, suppliers, laborers, equipment rental companies, design professionals
WHO IS EXEMPT
- Utah law does not provide explicit exemptions
- However, the notice requirement applies only to those who "desire to claim a construction lien"
TWO-STEP PROCESS TO PERFECT A LIEN
Step 1: Preliminary Notice (Utah Code § 38-1a-501)
- File with SCR within 20 days of commencing work
Step 2: Notice of Construction Lien (Utah Code § 38-1a-502)
- File within the earlier of:
- 180 days after final completion of original contract, OR
- 90 days after Notice of Completion is recorded (but no later than 180 days after final completion)
LIEN PRIORITY
All construction liens relate back to and take effect as of the date of the first preliminary notice filed for the project.
