PRELIMINARY NOTICE REQUIREMENTS
Delaware does NOT require any preliminary notice before filing a mechanics lien. Construction participants are not obligated to serve a preliminary notice to preserve their lien rights.

FILING REQUIREMENTS (25 Del. C. § 2712)
The Statement of Claim must be filed with the Prothonotary of the Superior Court and must contain:
- Name of the claimant
- Name of the owner
- Description of the property
- Amount claimed
- Statement of the facts
- Verification under oath
SERVICE REQUIREMENTS
When filing a mechanics lien, claimant must notify:
- All lien holders
- All tenants who hold a leasehold interest on the property
LIEN WAIVER (25 Del. C. § 2706)
The lien may be waived by written agreement, but the waiver must be:
- In writing
- Signed by the person waiving the lien
- Supported by consideration
BEST PRACTICES (EVEN WITHOUT REQUIREMENTS)
Even though not required, sending a Notice of Intent to Lien:
- Puts the owner on notice of your involvement in the project
- May prompt quicker payment
- Establishes a paper trail for future lien enforcement
- Particularly helpful for subcontractors and suppliers on large projects
