FILING REQUIREMENTS (25 Del. C. § 2712)

The Statement of Claim must be filed with the Prothonotary of the Superior Court and must contain:

  • Verification under oath

SERVICE REQUIREMENTS

When filing a mechanics lien, claimant must notify:

  • All lien holders
  • All tenants who hold a leasehold interest on the property

LIEN WAIVER (25 Del. C. § 2706)

The lien may be waived by written agreement, but the waiver must be:

  • In writing
  • Signed by the person waiving the lien
