Wyoming requires TWO types of pre-lien notices:

  1. PRELIMINARY NOTICE (§ 29-2-112) - Required for ALL claimants
    - Contractors: Before receiving ANY payment from owner
    - Subcontractors/Suppliers: Within 30 days of first furnishing

  2. NOTICE OF INTENT TO LIEN (§ 29-2-107) - Required for ALL claimants
    - At least 20 days before filing lien statement

SERVICE METHOD

ALL preliminary notices must be sent via certified mail with return receipt requested to the property owner.

CONSEQUENCES OF FAILURE TO SEND NOTICE

Under § 29-2-112(a)(ii)(B): "Failure to send the notice required under this section within the time specified shall bar the right of a contractor, subcontractor or materialman to assert a lien."

This is strictly enforced - there is no apparent leniency for late notice.

NOTICE FORMAT (§ 29-2-112(c))

The notice must be:
- Substantially the same format as in Wyo. Stat. § 29-10-101
- Forms available at county clerk's office

CONTRACTOR'S OBLIGATION TO SUBCONTRACTORS (§ 29-2-112(b))

At time of contracting, contractor must provide subcontractors/materialmen:
- Name and address of record owner
- Name and address of owner's agent (if applicable)
- Legal description of the site

LIEN WAIVER RIGHTS

Owner has the right to obtain a lien waiver upon payment for services or materials. The notice must inform owner of this right.
