SERVICE METHOD
ALL preliminary notices must be sent via certified mail with return receipt requested to the property owner.
CONSEQUENCES OF FAILURE TO SEND NOTICE
Under § 29-2-112(a)(ii)(B): "Failure to send the notice required under this section within the time specified shall bar the right of a contractor, subcontractor or materialman to assert a lien."
This is strictly enforced - there is no apparent leniency for late notice.
NOTICE FORMAT (§ 29-2-112(c))
The notice must be:
- Substantially the same format as in Wyo. Stat. § 29-10-101
- Forms available at county clerk's office
CONTRACTOR'S OBLIGATION TO SUBCONTRACTORS (§ 29-2-112(b))
At time of contracting, contractor must provide subcontractors/materialmen:
- Name and address of record owner
- Name and address of owner's agent (if applicable)
- Legal description of the site
LIEN WAIVER RIGHTS
Owner has the right to obtain a lien waiver upon payment for services or materials. The notice must inform owner of this right.
