PRELIMINARY NOTICE REQUIREMENTS
New York does NOT require preliminary notice. However, the lienable fund is limited to the amount due under the general contract at the time the project owner has notice of claims and/or liens.

LIENABLE FUND LIMITATION
The lien cannot exceed the amount due under the contract at the time owner receives notice. Sending voluntary pre-lien notice helps preserve a larger fund.
PUBLIC IMPROVEMENTS
For public improvements, liens must be filed no later than 30 days after entire public improvement is completed and accepted.
