COLORADO CONSTRUCTION LIEN NOTICES - LEGAL REQUIREMENTS SUMMARY
NOTICE TO OWNER (C.R.S. § 38-22-113)
Purpose: To require the owner/disburser to withhold funds sufficient to pay the claimant
When Required: Optional - may be given at any time during the project
Effect: Once properly served, the owner/disburser must withhold the stated amount from payments to the principal contractor
NOTICE OF INTENT TO FILE LIEN (C.R.S. § 38-22-109(3))
Purpose: Required prerequisite to filing a lien statement
When Required: MANDATORY - at least 10 days before filing a lien statement
Recipients: Property owner AND principal contractor
Consequences of Failure: Lien statement cannot be filed without first serving this notice
LIEN STATEMENT FILING DEADLINES

LIEN DURATION AND ENFORCEMENT
- Lien statement is effective for 6 months from filing
- Can be extended by filing an affidavit stating work is not complete (within 30 days of 1-year anniversary)
- Enforcement lawsuit must be filed within the lien's effective period
OWNER-OCCUPIED SINGLE-FAMILY DWELLING DEFENSE
Under C.R.S. § 38-22-113(2), it is an affirmative defense if the owner has paid sufficient amounts to satisfy obligations when the property is:
- An existing single-family dwelling unit
- A residence constructed by the owner as primary residence
- A single-family, owner-occupied dwelling unit
DISBURSER NOTICE OPTION (C.R.S. § 38-22-126)
Any project participant may give a Disburser Notice to skip up the payment chain:
- If properly given, the disburser must pay the claimant directly
- If disburser fails to pay, they are directly liable for damages

- Contractors and subcontractors
- Mechanics, materialmen, and builders
- Suppliers of laborers, machinery, tools, or equipment
- Architects, engineers, and draftsmen
- Any person performing labor or furnishing materials
