IMPORTANT NOTICE
Maine does not require a traditional pre-lien "preliminary notice." However, claimants who do NOT have a direct contract with the property owner must file a sworn statement with the registry of deeds within 90 days after ceasing to provide labor, furnish materials, or perform services.
For residential projects or owner-occupied business/commercial/industrial projects, those without a direct contract must also give preliminary notice to the owner.

NOTICE TO PROPERTY OWNER
You are hereby notified that the undersigned has been engaged to perform work or furnish materials for the improvement of your property located at:

Under Maine law (10 M.R.S.A. §§ 3251-3269), persons who perform labor, furnish materials, or perform services for improvements to your property have a lien on the property to secure payment for their contributions.

To protect yourself:

WHO MAY CLAIM A LIEN (10 M.R.S.A. § 3251)

Work must be done "by virtue of a contract with or by consent of the owner."
SWORN STATEMENT REQUIREMENTS (10 M.R.S.A. § 3253(1)(A))
The sworn statement must include:
- Net amount due to claimant
- Description of property sufficient to identify it
- Name of the owner
SERVICE REQUIREMENTS
- File sworn statement in registry of deeds in county where property is situated
- Mail copy to owner by ordinary mail
CONTRACT REQUIREMENTS
Maine does NOT require a written contract to file a mechanics lien. Work done "by virtue of a contract with or by consent of the owner" is sufficient. Verbal contracts qualify.
DISSOLUTION OF LIEN
If claimant without contract with owner fails to file sworn statement within 90 days, the lien granted by § 3251 is dissolved.
ENFORCEMENT
Action to enforce lien must be filed in Superior Court or District Court in the county where property is located within 120 days after last furnishing labor, materials, or services.
