KANSAS CONSTRUCTION LIEN NOTICES - LEGAL REQUIREMENTS SUMMARY

WARNING STATEMENT (K.S.A. § 60-1103a)

When Required:
- Alterations or repairs to existing residential property

1. Mail Warning Statement to owner, OR
2. Obtain signed statement from owner acknowledging receipt

Consequence of Failure: Cannot claim a lien under K.S.A. § 60-1103

NOTICE OF INTENT TO PERFORM (K.S.A. § 60-1103b)

When Required:
- New residential construction
- By subcontractors and suppliers
- ONLY to protect lien rights after title passes to good faith purchaser

How to Comply:
- File with District Court in county where property is located
- Must be filed BEFORE deed is recorded transferring title

Consequence of Failure: Cannot claim lien after property transfers to good faith purchaser

WHO IS EXEMPT

  • General contractors with direct contract with owner
  • Suppliers to second-tier subcontractors - NO lien rights in Kansas

LIEN FILING DEADLINE

  • Subcontractors and other parties must file mechanics lien within 3 months of last furnishing labor or materials

LIEN STATEMENT REQUIREMENTS

  • Must name the contractor in the lien statement
