VERMONT MECHANICS LIEN - LEGAL REQUIREMENTS SUMMARY

PRELIMINARY NOTICE REQUIREMENTS

Vermont does NOT require any preliminary notice. This is rare among U.S. states.

KEY DEADLINES

Action Deadline Citation
Preliminary Notice NOT REQUIRED N/A
File Mechanics Lien 180 days from when payment became due 9 V.S.A. § 1923
Enforce Lien 180 days from filing 9 V.S.A. § 1924

WHO MAY CLAIM A LIEN (9 V.S.A. § 1921)

Persons who have a contract (written or not) for:
☐ Erecting improvements to real property
☐ Repairing improvements to real property
☐ Moving improvements to real property
☐ Altering improvements to real property
☐ Furnishing labor or materials for such work

The statute provides broad protection regardless of contract tier (subs, sub-subs, suppliers to subs, etc.).

LIEN CLAIM REQUIREMENTS

Technically Required by Statute:
- Date payment became due
- Claimant's signature

Recommended to Include:
- Legal property description or identification
- Description of work performed
- Party for whom work was performed
- Amount claimed

FILING LOCATION

File the mechanics lien with the Town Clerk of the town where the property is located.

LIEN DURATION

The lien continues for 180 days from the date it is filed, unless:
- Foreclosure action is commenced, OR
- Lien is otherwise discharged

BEST PRACTICES (Even Without Requirements)

Although not required, it is recommended to:
1. Send a preliminary notice or Notice of Intent to Lien to the owner
2. Send notice to the prime contractor
3. Maintain documentation of all work and communications
4. Send notice when the lien is filed

CONTRACT REQUIREMENTS

Vermont does NOT require a written contract. Work done pursuant to "a contract or agreement, whether in writing or not" qualifies for lien rights.

IMPORTANT DISCLAIMERS

This form is provided for informational purposes only and does not constitute legal advice. While Vermont has minimal preliminary notice requirements, the lien filing and enforcement deadlines must be strictly followed. Consult with a Vermont-licensed attorney to ensure compliance with all statutory requirements.

VERIFICATION: Ensure all information is accurate. The date payment became due is critical for the lien filing deadline.
