IMPORTANT NOTICE
Idaho does not require a traditional preliminary notice for most construction projects. However, for RESIDENTIAL projects exceeding $2,000, general contractors MUST provide a General Contractor Disclosure Statement to the homeowner before entering into the contract.
NOTE: This disclosure is required for anyone contracting directly with a homeowner, including specialty contractors if the homeowner is acting as their own general contractor.

DISCLOSURE OF LIEN RIGHTS (Idaho Code § 45-525)
IMPORTANT INFORMATION FOR HOMEOWNER
Under Idaho law, persons who labor upon or furnish materials for improvements to your property may have lien rights against your property if they are not paid. This means that if the general contractor fails to pay subcontractors or material suppliers, those parties may be able to place a lien on your property even if you have paid the general contractor in full.
YOUR RIGHTS AND PROTECTIONS:

Request Lien Waivers: You have the right to request lien waivers from all subcontractors and suppliers before making final payment to the general contractor.

Joint Checks: You may issue joint checks payable to both the general contractor and subcontractors/suppliers.

Withhold Payment: You may withhold sufficient funds from payment to the general contractor to cover amounts owed to subcontractors and suppliers until you receive appropriate lien waivers.
LIEN FILING DEADLINES:
- Contractors must file a lien within 90 days of their last day of non-trivial work
- Within 5 days of filing, the contractor must serve a copy on the property owner
SUBCONTRACTORS AND SUPPLIERS USED ON THIS PROJECT:
The general contractor agrees to provide the homeowner with a list of subcontractors and material suppliers upon request.

DEFINITION OF "GENERAL CONTRACTOR" (Idaho Code § 45-525)
Anyone who contracts directly with the homeowner is considered a "General Contractor" for purposes of the disclosure requirement. This includes:
- Traditional general contractors
- Specialty contractors hired directly by homeowner
- Any contractor when homeowner acts as own GC
CONSEQUENCES OF FAILURE TO PROVIDE DISCLOSURE
Failure to provide the required disclosure may:
- Affect the contractor's lien rights
- Subject the contractor to liability claims
- Impact the contractor's ability to collect on the contract
REQUIRED CONTENTS OF LIEN CLAIM (Idaho Code § 45-507)
When filing a lien, the claim must contain:
- Statement of demand after deducting credits/offsets
- Name of owner or reputed owner
- Name of person who employed claimant
- Description of property
- Statement that claimant has complied with Idaho Code § 45-525
