“Attorneys and self-represented litigants are cautioned against submitting to the Court any pleading, written motion, or other paper drafted using generative artificial intelligence (e.g., ChatGPT, Harvey.AI, generative AI services) without checking the submission for accuracy as certain technologies may produce factually or legally inaccurate content and should never replace the lawyer’s independent legal judgment.”

Filing

A signer remains responsible under Rule 11 for a court filing even if generative AI drafted part of it.

“Any attorney or self-represented litigant who signs a pleading, written motion, or other paper submitted to the Court will be held responsible for the contents of that filing under Rule 11, regardless of whether generative artificial intelligence drafted any portion of that filing.”

Filing

File highly sensitive documents on paper in a sealed, labeled envelope, delivered in person or by mail or commercial delivery service.

“A document filed under these HSD procedures must be filed in paper form in a sealed envelope labeled ‘Highly Sensitive Documents’ and with the case style and number, inside an outer mailing or delivery envelope. These documents may be filed only: (i) in person; (ii) by United States Mail; or (iii) by a commercial delivery service (such as Federal Express or UPS).”

Filing

Submit two physical copies of a highly sensitive document, one for the court record and one for the presiding judge.

“Two physical copies of each HSD filed under these procedures must be filed. One copy is the court record; the second is for the presiding judge. No separate courtesy copy is needed unless specifically requested.”
