North Dakota Tenant Notice of Intent to Vacate

North Dakota Timing and Lease-Clause Gate

N.D.C.C. § 47-16-15 permits either party to terminate a month-to-month tenancy with at least one calendar month's written notice, unless the parties agreed in writing to a longer period or different timing. A residential clause requiring notice more than one month from the end of a month must state the requirement and provide space for the tenant to initial it; if not initialed at execution, the tenant may terminate on the last day of a month with at least one calendar month's notice. A lease converted to month-to-month under §§ 47-16-06 or -06.1 likewise may be ended on the last day of a month with at least one calendar month's notice.
