Delaware Timing Gate

Under 25 Del. C. § 5106, a tenant may terminate a fixed-term rental agreement by at least 60 days' written notice before the term expires, stating that the agreement will terminate on its expiration date. For a month-to-month agreement, either party must give at least 60 days' written notice, and the 60-day period begins on the first day of the month following the day of actual notice. Federal law, regulations, or guidelines control in the event of a conflict for federally subsidized housing.
