This Agreement is made on [__/__/____] between [PRIMARY TENANT FULL NAME] (“Sublessor”) and [SUBTENANT FULL NAME] (“Subtenant”). The owner or primary landlord is [NAME] (“Primary Landlord”).
1. Dwelling, master lease, and authority

Master-lease subletting clause: [SECTION OR “NONE”]. Permission route: ☐ Attached master lease permits this sublease without further consent. ☐ Required Primary Landlord written consent is attached as Exhibit B or signed below. ☐ Housing-program permission is attached as Exhibit B. Subtenant will not take possession before required permission is documented. Sublessor remains responsible under the master lease and cannot give Subtenant a longer or greater right than Sublessor holds.
2. Term, rent, and services
The fixed sublease begins [__/__/____] and ends [__/__/____], no later than the lawful end of the master lease. An extension requires a writing signed by both parties and any required consenting person.
Monthly rent: $[____], due on day [____] to [PAYEE] by [METHOD] at [ADDRESS/ACCOUNT]. First partial month: $[____] for [DATES], due [__/__/____]. Late charge: $[____] if rent is unpaid [____] days after due; if either blank is empty, no charge is agreed. Sublessor will not charge a fee to accept cash, a check, or a money order for required payments. Utilities/services paid by Sublessor: [LIST]. Paid by Subtenant: [LIST AND ALLOCATION].
3. Security deposit and signed condition statement
Subtenant pays a refundable security deposit of $[____], no more than one month's rent under this Agreement. No separate pet deposit is collected. Sublessor will hold the deposit in a federally insured interest-bearing savings or checking account for Subtenant's benefit. Accrued interest will be paid when required; occupancy shorter than nine months does not require interest payment.
After this sublease terminates and Subtenant delivers possession, Sublessor may apply the deposit and interest only to unpaid rent, qualifying damage caused by Subtenant, guests, or a pet, and required cleaning or repairs beyond reasonable wear. Within 30 days after both events, Sublessor will deliver or mail a written itemization, the amount due, and the required notice to Subtenant's last address furnished to Sublessor. Forwarding address: [ADDRESS / TO BE PROVIDED].
Sublessor gives Subtenant the condition statement below with this Agreement. Both parties will inspect, complete, agree to, and sign it when entering this Agreement.
4. Care, entry, and contacts
Occupants: [NAMES]. Pets: [TERMS / NONE]. Parking/storage: [TERMS / NONE]. Subtenant will follow lawful master-lease rules, keep the space reasonably clean, promptly report repairs, and avoid damage beyond normal wear. Sublessor will coordinate Primary Landlord's duties and keep the premises fit and habitable as required by law. Sublessor's specific repair/service duties: [LIST].
For planned inspection, repair, services, or showings, Sublessor will enter at reasonable hours and in a reasonable manner. Unless impractical, Sublessor will first notify Subtenant and obtain consent for a specified time; Subtenant will not unreasonably withhold consent. Failure to object after actual notice of that time may constitute consent under North Dakota law. Emergency, abandonment, and substantial-violation entry routes remain subject to statute. Sublessor will not use entry to harass Subtenant.
Sublessor notice and repair address/phone: [DETAILS]. Subtenant notice address/phone: [DETAILS]. Emergency contact: [NAME/PHONE].
5. Notices, surrender, and exhibits
Contract notices will be written and delivered by [PERSONAL DELIVERY / MAIL / OTHER LAWFUL METHOD] to the listed addresses, subject to any stricter statutory rule. An early ending or possession action must follow the master lease and applicable law; this Agreement authorizes no self-help lockout. Landlord-tenant paperwork governs who can stay in a property, on what terms, and what happens when something goes wrong. Leases, notices to quit, security deposit demands, and habitability complaints all have state and often city-specific requirements for timing, content, and service. Getting the paperwork right is what makes an eviction actually succeed or a security deposit actually come back, because judges regularly dismiss cases over small procedural mistakes.
