ARTICLE III: LIMITED WARRANTY COVENANTS
Section 3.1 Statutory Special Warranty (ORS 93.855)
Pursuant to ORS 93.855, by executing this Special Warranty Deed, the Grantor covenants with the Grantee, the Grantee's heirs, successors, and assigns:
(a) That at the time of making this conveyance, the Grantor is seized of the property in fee simple and has good right and power to convey the same;
(b) That the property is free from all encumbrances created or suffered by the Grantor; and
(c) That the Grantor WILL WARRANT AND FOREVER DEFEND the title to the property against all persons lawfully claiming by, through, or under the Grantor, but against none other.
Section 3.2 Effect of Special Warranty Language (ORS 93.855)
The statutory form of special warranty deed (ORS 93.855) provides the same warranties as a general warranty deed, EXCEPT that the warranty extends only to claims arising during the grantor's ownership of the property.
Section 3.3 Limitation of Warranty
NOTICE: This is a SPECIAL WARRANTY DEED. The covenants contained herein are LIMITED to claims arising from acts or omissions of the Grantor during Grantor's period of ownership. This deed does NOT warrant against:
- Defects in title existing prior to Grantor's ownership
- Liens or encumbrances created by prior owners
- Claims of persons NOT claiming by, through, or under Grantor

ARTICLE V: TRANSFER TAX INFORMATION
Section 5.1 Oregon Transfer Tax (ORS 306.815)
Oregon generally prohibits local transfer taxes (ORS 306.815), with one grandfathered exception:

☐ All Other Counties: No transfer tax applies
Note: Oregon is exceptionally transfer-tax-friendly compared to other states.
