ARTICLE III: LIMITED WARRANTY COVENANTS
Section 3.1 Special Warranty (KRS 382.040)

Section 3.2 Limitation of Warranty
NOTICE: This is a SPECIAL WARRANTY DEED. The covenants contained herein are LIMITED to claims arising from acts or omissions of the GRANTOR during GRANTOR's period of ownership. This deed does NOT warrant against:
- Defects in title existing prior to GRANTOR's ownership
- Liens or encumbrances created by prior owners
- Claims of persons NOT claiming by, through, or under GRANTOR

Important Kentucky Requirements

Both Parties Must Sign: Kentucky requires BOTH Grantor AND Grantee to sign the deed in front of a notary (KRS 382.130).

Attorney Preparation: Preparation of deeds constitutes the practice of law in Kentucky and should be done by an attorney.

Dower/Curtesy: Kentucky recognizes dower/curtesy interests. A non-titled spouse must join to release such interest (KRS 392.020).

Vesting Statement: How grantee will hold title must be stated (KRS 382.135).

Consideration Statement: Full amount of consideration OR fair cash value must be stated (KRS 382.135).

Tenants by the Entirety: Available for married couples - provides creditor protection (KRS 381.050(1)).
