Transfer Tax
Utah does NOT impose a state real estate transfer tax.
This makes Utah one of the most affordable states for property transfers compared to neighboring states like Colorado and Nevada.
Security Instruments
Utah uses trust deeds rather than mortgages as the primary security instrument for real estate loans.
Recording Priority (Utah Code 57-3-102, 57-3-103)
Each document not recorded is void as against a subsequent document first duly recorded. Utah follows a race-notice recording system.
Important Legal Notes
-
No Transfer Tax: Utah is one of the states without a real estate transfer tax.
-
Trust Deeds: Utah primarily uses trust deeds (deeds of trust) rather than mortgages.
-
Constructive Notice: Recording provides constructive notice of the conveyance.
-
Priority: The first to record generally has priority (race-notice state).
-
Statutory Form: This deed follows the statutory form under Utah Code 57-1-12.5.
-
Title Insurance: Grantees should consider obtaining title insurance, especially given the limited warranty nature of this deed.
-
Legal Counsel: Consultation with a licensed Utah attorney is recommended.
-
Buyer Pays Recording: In Utah, the buyer typically pays to record the deed and mortgage, while the seller pays to record documents removing encumbrances.

About This Template
Real estate documents transfer ownership, define who can use a property, and record agreements between buyers, sellers, landlords, and tenants. Deeds, purchase agreements, leases, and easements have to be drafted to meet state recording requirements, and mistakes show up at closing or years later in title disputes. Good real estate paperwork moves transactions forward quickly and avoids the kind of problems that only surface when it is time to sell or refinance.
Important Notice
This template is provided for informational purposes. It is not legal advice. We recommend having an attorney review any legal document before signing, especially for high-value or complex matters.
