Sealing

After filing, sealed documents are no longer accessible or viewable in CM/ECF.

Sealing

Serve sealed documents conventionally under the applicable federal procedure rules; the court mails sealed court-generated documents.

“Parties must serve sealed documents conventionally by other appropriate means as provided by the Federal Rules of Procedure. (See, Fed. R. Civ. P. 5, Fed. R. Crim. P. 49.) The Court will serve sealed orders, notices, and other Court-generated documents by U.S. mail to attorneys of record and self-represented parties.”

Sealing

A party seeking highly sensitive document treatment must deliver paper copies of the motion, proposed documents, proposed order, and, when required, a certificate of service to the clerk.

“The filing party shall deliver in paper to the Clerk’s Office, one original and a copy of: the Motion to Designate Highly Sensitive Documents, the proposed Highly Sensitive Documents, a Proposed Order to Designate Highly Sensitive Documents that are to be filed outside of CM/ECF and remain sealed until otherwise ordered; and unless the documents are submitted ex parte, a certificate of service for the motion.”

Sealing

Responses to a highly sensitive document designation motion are due within 14 days, must be filed on paper in a marked sealed envelope, and may not be followed by replies.

“Any response to the Motion to Designate Highly Sensitive Documents must be filed within 14 days of the filing of the Motion to Designate. The response shall be filed in paper in a sealed envelope marked ‘HIGHLY SENSITIVE DOCUMENT.’”
