ALASKA MECHANICS LIEN WAIVER AND RELEASE PACK
Pursuant to Alaska Statutes AS 34.35.050 - 34.35.120
ALASKA-SPECIFIC PRACTICE NOTES
Statutory Framework for Lien Waivers
Alaska mechanics lien law is codified at AS 34.35.050 through AS 34.35.120. Under AS 34.35.117, lien waivers in Alaska operate as follows:
(a) A written waiver of lien or stop-lending notice rights signed by a claimant requires no consideration and is valid and binding. However, a waiver may not relate to labor, materials, services, or equipment furnished after the date the waiver is signed.
(b) An individual described in AS 34.35.120(10) (individual employees performing labor) may not waive their right to claim a lien. Any purported waiver of such rights is void.
Lien Filing Deadlines (AS 34.35.068)
Without Notice of Completion:
☐ 120 days after claimant completes the construction contract; OR
☐ 120 days after claimant ceases to furnish labor, material, services, or equipment
With Notice of Completion (AS 34.35.071):
☐ 15 days after notice of completion is recorded — applies only to claimants who:
- Received advance notification (at least 5 days before recording); AND
- Did not file a Notice of Right to Lien
☐ 120 days preserved if claimant:
- Recorded a Notice of Right to Lien at least 10 days before the Notice of Completion; OR
- Filed a Notice of Right to Lien within 15 days after the Notice of Completion; OR
- Did not receive the required 5-day advance notice from the owner
Notice Requirements
☐ No Preliminary Notice Required: Alaska does not require a preliminary notice to preserve lien rights
☐ Notice of Right to Lien (AS 34.35.064): Optional but recommended; shifts burden of proof to owner and may preserve the 120-day filing deadline
☐ Notice of Completion (AS 34.35.071): Owner may record after project completion; triggers shortened 15-day deadline for certain claimants
Stop-Lending Notice Rights (AS 34.35.062)
☐ Claimants with past-due payments may serve a stop-lending notice on the construction lender
☐ Stop-lending notice expires 90 days after lender's receipt unless action is commenced
☐ Lender who disburses funds after receiving stop-lending notice may be liable to claimant
☐ Waivers under AS 34.35.117 apply to both lien rights AND stop-lending notice rights
Lien Duration and Enforcement (AS 34.35.080)
☐ A recorded lien binds real property for 6 months after recording
☐ May be extended for an additional 6 months by filing a Notice of Extension
☐ If no enforcement action is commenced within the applicable period, the lien expires
Parties with Lien Rights (AS 34.35.050)
- Persons performing labor on real property at the owner's request
- Trustees of employee benefit trusts with direct owner contracts
- Material suppliers with direct owner contracts (materials must be delivered and incorporated)
- Equipment suppliers or lessors with direct owner contracts
- Architects, surveyors, and engineers under contract with the owner
Key Practice Considerations
☐ Written Waiver Required: All waivers must be in writing and signed by the claimant
☐ No Consideration Necessary: Alaska law explicitly states consideration is not required
☐ No Statutory Form: Alaska does not mandate a specific lien waiver form
☐ Notarization: Not legally required but recommended for evidentiary purposes
☐ Future Work Prohibition: Waivers cannot cover work performed after the signing date
☐ Employee Protection: Individual employees cannot waive their lien rights — any such waiver is void
☐ Conditional vs. Unconditional: Unconditional waivers are effective immediately upon signing, even if payment has not been received
Alaska Recording Districts
Alaska uses judicial districts for recording purposes:
- First Judicial District — Juneau, Southeast Alaska
- Second Judicial District — Nome, Western Alaska
- Third Judicial District — Anchorage, Kenai, Kodiak, Southcentral Alaska
- Fourth Judicial District — Fairbanks, Interior Alaska
Verify the correct recording district with the Alaska Department of Natural Resources, Recorder's Office.

UNCONDITIONAL WAIVER AND RELEASE LANGUAGE — FINAL
The undersigned Claimant has been paid in full and has received final payment in the sum of $[________________________________] for all labor, materials, services, or equipment furnished to the property described above in connection with this project.
The undersigned Claimant unconditionally waives and releases any and all mechanic's lien, stop-lending notice, or claim of lien rights the Claimant has on the real property described above for all labor, materials, services, or equipment furnished to that real property in connection with this project.
THIS WAIVER AND RELEASE IS UNCONDITIONAL AND EFFECTIVE IMMEDIATELY UPON EXECUTION.
This waiver is binding regardless of whether payment has actually been received, and the Claimant acknowledges that third parties may rely on this waiver in making payments or taking other actions with respect to this project.
This unconditional waiver constitutes a full and complete release of all lien rights and stop-lending notice rights of the Claimant for all labor, materials, services, and equipment furnished in connection with this project.
Pursuant to AS 34.35.117(a), this waiver does not and may not relate to labor, materials, services, or equipment furnished after the date this waiver is signed.
