Overview of Florida Construction Lien Waiver Law
Fla. Stat. § 713.20 supplies two statutory form bases: one for a progress payment and one for final payment. “Conditional” and “unconditional” are not four separate Florida statutory categories. A lienor exchanging a waiver or release for a check may condition it on payment of that check under subsection (7). The four drafting variants below must be conformed by Florida counsel to the applicable progress or final statutory form and the actual payment method.

Florida Statutory Waiver Form Requirements (§ 713.20)
Statutory Forms: Subsections (4) and (5) provide the progress-payment and final-payment forms. Subsection (6) bars requiring a lienor to furnish a different form. Subsection (7), not subsection (6), permits a lienor exchanging a waiver or release for a check to condition it on payment of the check. Subsection (8) addresses enforceability of a form that is not substantially similar.
Advance Waiver Prohibition
Florida does not permit a blanket advance waiver of all lien rights before work begins. Under § 713.20, waivers must relate to specific payments for specific work periods.
Notice to Owner Requirement
All lienors other than the general contractor and laborers must serve a Notice to Owner within 45 days of first furnishing labor, services, or materials (§ 713.06(2)). Failure to serve timely notice may limit or bar lien rights. The Notice to Owner is separate from the lien waiver.
When to Use Each Form
- Progress statutory-form base — use for labor, services, or materials furnished through a stated date; identify retention and later furnishing as the statutory form does.
- Final statutory-form base — use for final payment.
- Check-payment condition — if the waiver or release is exchanged for a check, counsel may add the subsection (7) payment condition to the applicable progress or final form.

WARNING: Section 713.21 governs discharge of a recorded lien through the routes stated there. It does not state the former template's five-day demand or $10,000 penalty. Use a separate current satisfaction, release, or court procedure for a recorded Claim of Lien.
WARNING: The contractor's Final Payment Affidavit is governed by § 713.06(3)(d)1., not § 713.235. It is separate from the waiver forms.

This waiver and release is unconditional and irrevocable. It covers ALL work, labor, services, and materials furnished by the undersigned on the Project from commencement through final completion, including retainage, change orders, extras, and all other amounts.
The undersigned acknowledges and represents that:

CONTRACTOR'S FINAL PAYMENT AFFIDAVIT REMINDER
Under Fla. Stat. § 713.06(3)(d)1., when final payment under the direct contract becomes due, the contractor gives the owner a Final Payment Affidavit stating whether timely-noticing lienors have been paid in full and listing each unpaid lienor and amount due or to become due. This is separate from the waiver forms above.
