Connecticut Deceased Tenant Estate and Landlord Coordination Packet

Connecticut Landlord & Tenant Updated October 3, 2026 Free Word and PDF

CONNECTICUT DECEASED TENANT ESTATE AND LANDLORD COORDINATION PACKET

Before use: This packet covers the optional Conn. Gen. Stat. § 47a-11d route only when the deceased person was the sole occupant under a monthly or term lease and the landlord has complied with any lease provision permitting termination upon death. If the landlord knows or reasonably should know the dwelling has not been abandoned, ordinary landlord and summary process protections still apply. An emergency contact or relative gains no estate authority from this packet. Use the current official Probate Court forms PC-2106 and PC-2406 and Superior Court form JD-HM-39 for the filings; the worksheets here do not replace those forms.

A. Landlord's notice to designated contact or known next of kin

Date: [__/__/____] To: [NAME / LAST-KNOWN ADDRESS] Re: [DWELLING ADDRESS]

[OCCUPANT NAME], the sole occupant identified in our records, died on [DATE]. I intend to remove possessions and personal effects remaining at the dwelling and to rerent it through the procedure in Conn. Gen. Stat. § 47a-11d. Please contact me or the Probate Court for the district where the dwelling is located immediately for information about reclaiming the possessions and personal effects.

Landlord contact: [NAME], [MAILING ADDRESS], [TELEPHONE]. Probate Court: [COURT NAME], [TELEPHONE].

If the possessions and personal effects are not reclaimed within 60 days after the date of this notice, they will be disposed of only as permitted by § 47a-11d. The date of this notice is [DATE]; the calculated 60th day is [DATE]. Please provide any appointment or Probate Court document showing who is authorized to act for the estate, and request a time for access or handoff. Contact or family status alone does not establish that authority.

Send this notice, where a designated contact or known next of kin exists, to each required recipient at the last-known address by both prepaid regular mail and certified mail, return receipt requested.

B. Estate representative's access and preservation request

Date: [__/__/____] To landlord: [NAME / ADDRESS]

I am [NAME], acting as ☐ Probate Court appointed executor ☐ appointed administrator ☐ court-designated person under § 45a-273 ☐ other claimant seeking review of authority. My supporting document is [COURT / CASE / ORDER / DATE / ATTACHMENT]. Please identify the dwelling's property status and arrange a documented access or handoff appointment at [DATE / TIME OR REQUESTED OPTIONS]. Please preserve the items while authority and the statutory route are checked. Send copies of the § 47a-11d notice, Probate Court affidavit and inventory, if filed, to [ADDRESS / CONTACT METHOD].

I have filed, or know of, an application for probate of a will or letters of administration: ☐ yes, [COURT / CASE / FILING DATE] ☐ no known filing. A filing within 55 days after the landlord's affidavit triggers § 47a-11d(f)'s stop rule; please verify the filing date with the Probate Court before taking further steps. This request does not claim a right to remove another person's property merely because I am a relative or emergency contact.

Signature: ______________________________ Capacity: [CAPACITY] Date: [__/__/____]

C. Landlord's Probate Court and property timeline

Use official PC-2106 for the affidavit and official PC-2406 for the inventory. Record actual filing dates; the notice's 60-day clock and the affidavit's 60-day certificate clock have different starting events.

E. Marshal and municipal disposition record

Complete this section only after execution. The state marshal, not this packet, gives the municipality at least 24 hours' written removal notice and annotated inventory, and makes reasonable efforts to notify known contacts and kin. The municipality handles any later public auction. Before actual sale, a Probate Court appointed executor or administrator, or a court-designated person under § 45a-273, may reclaim property upon payment of the municipality's storage expense.

Legal authority

  • Conn. Gen. Stat. § 47a-11d

Landlord-tenant paperwork governs who can stay in a property, on what terms, and what happens when something goes wrong. Leases, notices to quit, security deposit demands, and habitability complaints all have state and often city-specific requirements for timing, content, and service. Getting the paperwork right is what makes an eviction actually succeed or a security deposit actually come back, because judges regularly dismiss cases over small procedural mistakes.
