ALABAMA MANUFACTURED DWELLING DECEASED TENANT ESTATE AND COMMUNITY OWNER COORDINATION PACKET

Use only for a manufactured dwelling in a community covered by Ala. Code chapter 35-12A. Section 35-12A-14 applies when the only tenant has died and the dwelling or personal property is considered abandoned under the chapter. Death alone does not establish the § 35-12A-1(1) abandonment facts. The notice and agreement forms below address that specific route; title, lease termination, possession and any sale remain separate questions.

A. Community owner's conditional notice and contact request

Date: [__/__/____] To: [PERSONAL REPRESENTATIVE / DESIGNATED PERSON / OTHER REQUIRED RECIPIENT] Address: [ADDRESS]

[TENANT NAME], the only tenant identified for [COMMUNITY / SPACE], died on [DATE]. The manufactured dwelling is [DESCRIPTION / IDENTIFIERS] and remains at [SPACE]. We have recorded the separate abandonment facts under Ala. Code § 35-12A-1(1) as [BRANCH / FACTS / DATES / SUPPORTING RECORD]. Rental fees asserted as unpaid are [ITEMIZED AMOUNTS / PERIODS / BASIS]. If those predicates are disputed, please notify us promptly with supporting information.

This notice is given under Ala. Code §§ 35-12A-3, -5 and -14. The home is stored on its rented space, and the applicable storage charge asserted is [AMOUNT / PERIOD / BASIS]. Please contact [OWNER NAME / PHONE / MAILING ADDRESS] within thirty days after receipt of this notice to arrange removal by appointment at a reasonable time or to identify a timely § 35-12A-14(4) request. The specified response date is [DATE, CALCULATED FROM RECEIPT]. Available appointment times are [TIMES / CONTACT].

If the required written contact is not made by the specified date, a sale may be considered only if every applicable condition of chapter 35-12A is met. A lien with priority over the community owner's lien invokes the separate § 35-12A-13 lienholder route; this letter is not a determination of priority. A timely personal representative, designated person or other entitled person's actual-notice request for a written § 35-12A-14(4) agreement must be addressed before any sale or disposal decision.

Community owner or agent: ______________________________ Title: [TITLE]

Delivery checklist: Personal representative named in a will or appointed by court: ☐ personal delivery ☐ first-class mail. Designated person: [METHOD / ADDRESS / PROOF]. Lienholders shown in the required records: ☐ certified mail with return receipt ☐ registered mail with return receipt, with copy of this notice. Other § 35-12A-3 service and proof: [METHOD / DATE / RECORD].

B. Recipient's actual-notice response and agreement request

Date: [__/__/____] To community owner: [NAME / ADDRESS] Dwelling and space: [DESCRIPTION / ADDRESS]

I received the notice on [DATE] and provide actual notice of my response on [DATE / METHOD / PROOF]. I am [NAME] acting as ☐ will-named personal representative ☐ court-appointed personal representative ☐ person designated in writing by the tenant ☐ another person entitled to possession, as [HEIR / DEVISEE / OTHER BASIS]. My supporting document or facts are [DOCUMENT / DESCRIPTION / ENCLOSED]. A designation for contact is identified separately from an estate appointment.

I ☐ dispute the stated abandonment, unpaid-fee, ownership or lien facts as follows: [FACTS / RECORDS] ☐ request a removal appointment on [DATE / TIME] ☐ request the written no-sale agreement under Ala. Code § 35-12A-14(4). If I request that agreement, I propose storage payments of [AMOUNT / SCHEDULE / BASIS] and property and space maintenance as [PLAN]. Please identify the account, any lienholder notice, and an appointment to inspect the home and contents with a person authorized to grant access.

This response does not personally guarantee a debt or waive a claim to the home or its contents. Any sale, transfer, continued occupancy or lease requires its own applicable authority and community approval where lawfully required.

Responding person: ______________________________ Capacity: [CAPACITY] Date: [__/__/____]

Delivery and attachments: [METHOD / DATE / PROOF / AUTHORITY DOCUMENTS]

C. Written § 35-12A-14(4) no-sale coordination agreement

Community owner: [NAME] Responding person and capacity: [NAME / CAPACITY / DOCUMENT] Home and space: [DESCRIPTION]

The community owner received the responding person's actual notice on [DATE], within the applicable thirty-day § 35-12A-5 period calculated from notice receipt on [DATE]. The responding person requested this agreement and identified the basis for entitlement to possession as [DOCUMENT / FACTS]. The parties record any unresolved claim or lien as [DETAILS].

While this agreement is in force and the responding person makes timely periodic payment of all storage charges and maintains the home and rented space as stated below, the community owner will not sell or dispose of the manufactured dwelling until the conclusion of any probate proceedings. This agreement does not itself transfer title or approve the responding person or a purchaser as a tenant.

Agreed operating term Fillable record
Storage charge, basis and payment dates [AMOUNT / PERIOD / DUE DATE / PAYMENT ADDRESS]
Home and space maintenance [DUTIES / ACCESS ARRANGEMENTS / CONDITION RECORD]
Probate proceeding and status contact [COURT / CASE / CONTACT / STATUS / NONE FILED]
Home, contents, title and lien documents [LIST / HOLDER / ACCESS OR REMOVAL LIMIT]
Proposed removal or authorized sale/transfer plan [PERSON / DOCUMENTS / DATE / COMMUNITY APPROVAL ISSUE]
Notice addresses for both parties [ADDRESSES / DELIVERY RECORD]

If the responding person violates this agreement, the community owner may use § 35-12A-14(4)'s thirty-day written notice stating sufficient facts and opportunity to correct before treating the agreement as terminated. Any later sale still requires the other chapter 35-12A gates. The parties will document the violation, notice, response and correction separately.

Landlord-tenant paperwork governs who can stay in a property, on what terms, and what happens when something goes wrong. Leases, notices to quit, security deposit demands, and habitability complaints all have state and often city-specific requirements for timing, content, and service. Getting the paperwork right is what makes an eviction actually succeed or a security deposit actually come back, because judges regularly dismiss cases over small procedural mistakes.
