ARIZONA DECEASED TENANT ESTATE AND LANDLORD COORDINATION PACKET

Before use: A.R.S. § 33-1314(E)-(F) applies to the tenant's personal property only if periodic rent has been unpaid and outstanding for at least five days; its animal provisions apply if the tenant is deceased or incapacitated. Death alone does not establish abandonment or end a lease. Review the lease, any estate appointment, possession, rent and deposit separately before using a property-disposition step.

Legal authority

  • A.R.S. § 33-1314(E)-(G)
  • A.R.S. § 33-1370(A), (D)-(H), (J)

Landlord-tenant paperwork governs who can stay in a property, on what terms, and what happens when something goes wrong. Leases, notices to quit, security deposit demands, and habitability complaints all have state and often city-specific requirements for timing, content, and service. Getting the paperwork right is what makes an eviction actually succeed or a security deposit actually come back, because judges regularly dismiss cases over small procedural mistakes.
