Sublease Agreement - Arkansas
SUBLEASE AGREEMENT (ARKANSAS)
Before you use this: Attach the entire Master Lease and its amendments. This agreement is conditioned on written consent from the master landlord, shown below, and on Sublandlord's continued right to sublet. Complete the consent before Subtenant takes possession.
This Sublease Agreement is made on [__/__/____] between [SUBLANDLORD LEGAL NAME] ("Sublandlord"), the tenant under the Master Lease, and [SUBTENANT LEGAL NAME(S)] (together, "Subtenant"). The master landlord is [MASTER LANDLORD NAME].
1. Premises and Master Lease
The Master Lease dated [__/__/____] covers the dwelling at [STREET ADDRESS, UNIT, CITY, AR ZIP] and is ☐ month-to-month ☐ scheduled to end on [__/__/____]. A complete copy, including amendments, is attached as Exhibit A.
Sublandlord subleases to Subtenant ☐ the entire dwelling ☐ the following private space: [DESCRIBE]. Shared areas and access: [DESCRIBE]. Included parking or storage: [DESCRIBE OR NONE]. Authorized occupants: [NAMES].
2. Consent and delivery
This Agreement becomes effective only when the master landlord signs the consent below and delivers a copy to both parties. Subtenant may not take possession before that delivery. Sublandlord will deliver possession and keys on [__/__/____] if consent has been delivered. The parties will then complete and sign a move-in condition record as Exhibit B.
Sublandlord remains responsible to the master landlord for Sublandlord's obligations under the Master Lease. The master landlord's consent here does not release Sublandlord from those obligations unless the master landlord separately agrees in writing.
3. Monthly term
The sublease begins [__/__/____] and continues from month to month until lawfully ended. It does not promise occupancy beyond Sublandlord's lawful right to possess the dwelling under the Master Lease. Sublandlord will promptly give Subtenant a copy of any notice that may end or materially change the Master Lease. The parties will cooperate in a lawful transition if the Master Lease ends; nothing here waives Subtenant's rights under controlling law.
4. Rent and utilities
Subtenant will pay Sublandlord $[AMOUNT] for each full rental month, due on day [1-28] of each month by [METHOD] at [PAYMENT ADDRESS OR ACCOUNT]. Each full rental month begins on that selected day and ends the day before the same day in the next month. The first full rental month, if one occurs, is [START DATE THROUGH END DATE / NONE], with monthly rent due [__/__/____ / N/A] on the selected due day. Rent for the first partial period, if any, is $[AMOUNT / ZERO] for [START DATE THROUGH END DATE / NONE], due [__/__/____ / NONE] to Sublandlord. If this sublease lawfully ends before a full rental month begins, enter "none" and "N/A" for that unused month and its due date; the initial partial payment covers the agreed occupancy dates. If this sublease lawfully ends during a later rental month, final partial rent is $[AMOUNT / ZERO] for [START DATE THROUGH END DATE / NONE], due [__/__/____ / NONE] to Sublandlord. Write "none" if a partial period does not apply. Each partial payment replaces monthly rent for its listed dates, so those dates are not charged twice. Do not complete a final partial payment for dates already covered by the initial partial payment. No late fee or returned-payment fee is agreed. Sublandlord remains responsible for paying the master landlord under the Master Lease.
Sublandlord will credit rent already paid for dates covered by a completed partial-period amount. Sublandlord will refund any excess for the initial partial period within 15 days after that period ends, and any excess for a final partial period within 15 days after this sublease ends.
Sublandlord pays [UTILITIES]; Subtenant pays [UTILITIES]. Shared utilities are allocated by [FORMULA AND BILL ACCESS]. A change to rent or charges requires a written amendment signed by Sublandlord and Subtenant or another route permitted by controlling law.
5. Security deposit
Subtenant pays Sublandlord a refundable deposit of $[AMOUNT] at signing, no more than two months' periodic sublease rent. The parties agree to that limit even if the limited small-owner exemption in Ark. Code Ann. § 18-16-303 would otherwise apply. Within 30 days after both this sublease ends and Subtenant delivers possession, Sublandlord will account for and return the deposit, less only documented deductions for accrued unpaid rent or loss caused by Subtenant's noncompliance with this Agreement. Sublandlord will provide an itemized statement with any balance. This 30-day return period is Sublandlord's contractual promise, shorter than the statutory 60-day period in § 18-16-305; any shorter controlling period applies.
If Sublandlord mails the statement and balance, Sublandlord will use first-class mail to Subtenant's last known address. If the payment is returned undelivered, Sublandlord will make reasonable efforts to locate Subtenant before treating it as Sublandlord's property 180 days after mailing under § 18-16-305(b). Subtenant will give a forwarding address. The deposit is not the last month's rent unless the parties later agree in writing.
6. Use, care, repairs, and access
Subtenant will use the space as a residence and comply with the attached Master Lease terms that apply to this occupancy and do not conflict with controlling law. Subtenant will keep the space reasonably clean, promptly report needed repairs to [SUBLANDLORD CONTACT], and pay for damage caused by Subtenant or guests beyond ordinary wear.
Sublandlord will pass repair requests requiring master landlord action to the master landlord and perform Sublandlord's own agreed duties. For nonemergency entry by Sublandlord, at least 24 hours' notice at a reasonable time is an agreed term; Subtenant's consent or an emergency may permit earlier entry. The master landlord's access remains governed by the Master Lease and controlling law.
The dwelling must have available hot and cold running water, electricity, potable drinking water, sanitary sewer and plumbing conforming to the codes applicable when installed, a functioning roof and building envelope, and functioning heating and air conditioning to the extent those systems served the dwelling when this Agreement was made. The implied standards in Ark. Code Ann. § 18-17-502 apply subject to that section's stated exceptions; no renovation or lease-purchase arrangement is created here. Subtenant will give Sublandlord written notice specifying any noncompliance by certified mail or the notice method agreed in Section 8. If rent is current, the noncompliance is not excused under § 18-17-502(c), and Sublandlord does not remedy it within 30 calendar days after receiving notice, Subtenant may terminate without penalty under § 18-17-502(d) and receive the recoverable deposit. Subtenant may not offset or withhold rent for a violation of those implied standards.
7. Changes and ending the monthly sublease
Subtenant may not assign this sublease or further sublet without written consent from Sublandlord and the master landlord. Either Sublandlord or Subtenant may end the month-to-month sublease by written notice delivered to the other at least 30 days before the stated termination date, under Ark. Code Ann. § 18-17-704(b). A party seeking possession or another remedy must use the process required by controlling law.
Subtenant will return possession and keys when this sublease lawfully ends, ordinary wear excepted. A signed move-out condition record may document any deposit deductions.
8. Notices and general terms
Sublandlord's notice address is [ADDRESS]; Subtenant's notice address is [ADDRESS]. Routine written notices will be delivered personally or by [TRACKED MAIL METHOD]. Statutory notices must also satisfy the applicable delivery rules. Arkansas law governs. Controlling law prevails over any conflicting term. Changes must be in writing and signed by Sublandlord and Subtenant.
Exhibit A (Master Lease and amendments), Exhibit B (condition record), and Exhibit C (master landlord's written consent, if separate from the signature below) are attached and incorporated.

Landlord-tenant paperwork governs who can stay in a property, on what terms, and what happens when something goes wrong. Leases, notices to quit, security deposit demands, and habitability complaints all have state and often city-specific requirements for timing, content, and service. Getting the paperwork right is what makes an eviction actually succeed or a security deposit actually come back, because judges regularly dismiss cases over small procedural mistakes.
