Residential Sublease Agreement - Alabama
Residential Sublease Agreement — Alabama
Before you use this: Attach the signed master lease and check its subletting and consent terms. Obtain any consent it requires before the Subtenant takes possession. This sublease cannot promise occupancy longer than the primary tenant may occupy under the master lease.
This Sublease Agreement is made on [__/__/____] between [PRIMARY TENANT NAME] (“Sublessor”) and [SUBTENANT NAME] (“Subtenant”). The primary landlord is [LANDLORD NAME]. The parties agree as follows.
Premises and master lease
Address: [STREET, UNIT, CITY, ALABAMA, ZIP].
Space sublet: ☐ Entire dwelling ☐ Only [ROOM OR AREA], with shared use of [COMMON AREAS].
Master lease dated: [__/__/____]. Master lease ends: [__/__/____]. A copy and amendments are attached as Exhibit A and were given to Subtenant before signing.
This sublease is subordinate to the master lease. Subtenant will follow the attached provisions concerning use, occupants, guests, pets, noise, utilities, access, and care of the premises to the extent applicable to the space sublet and consistent with Alabama law. The master lease remains between Sublessor and the primary landlord; this agreement does not release Sublessor from it. Sublessor remains responsible under the master lease unless the landlord separately agrees otherwise in writing. If a master lease term and this sublease conflict, the parties will apply the lawful term consistent with the landlord's authorization, and promptly document an agreed correction.
Term and authorization
Occupancy begins: [__/__/____]. Occupancy ends: [__/__/____]. This is a fixed term and may not extend beyond the master lease. An extension requires a signed writing and any consent required by the master lease.
Master lease authorization: ☐ Written landlord consent is attached or signed below. ☐ The master lease permits this sublease without further consent; identify clause: [________]. Subtenant will not take possession until the selected authorization is documented.
Rent, deposit, and utilities
Rent: $[________] each month, due on the [____] day to [PAYEE AND PAYMENT METHOD]. First payment: $[________] due [__/__/____]. Any partial month's rent is $[________] for [DATE RANGE].
Utilities and services: [SPECIFY EACH PAYER, AMOUNT OR SPLIT, AND DUE DATE].
Security deposit: $[________], received on [__/__/____]. Except for an amount tied to pets, changes to the premises, or increased liability risk allowed by Alabama law, Sublessor may not demand more than one month's periodic rent as security. Additional security, if legally applicable: $[________] for [SPECIFIC BASIS], or ☐ None.
After termination and delivery of possession, Sublessor may apply security to unpaid rent and losses caused by Subtenant's noncompliance as Alabama law permits. Sublessor will send any refund and an itemized list of deductions within 60 days. Subtenant will give Sublessor a written forwarding address at move-out: [________________________________]. A signed move-in condition record is attached as Exhibit B.
Use and care
Only [NAMES OF APPROVED OCCUPANTS] may reside in the sublet space. Guests: [MASTER LEASE RULE OR AGREED LIMIT]. Pets: [MASTER LEASE RULE OR AGREED TERMS]. Subtenant will keep the space clean, use facilities reasonably, avoid damage and disturbances, and promptly report repair or safety concerns to Sublessor. Sublessor will communicate with the primary landlord and perform applicable Alabama landlord duties. This agreement does not waive a right or duty that Alabama law makes nonwaivable.
Ending occupancy and notices
The fixed term ends on the stated end date, subject to the master lease and Alabama law. Early termination requires a signed agreement or an applicable legal ground. If the parties later create a month-to-month subtenancy, either may terminate it by written notice at least 30 days before the periodic rental date specified in the notice. A week-to-week tenancy requires at least seven days before the specified termination date. Subtenant will return keys and possession, remove belongings, and provide a forwarding address. The parties will use lawful possession procedures.

Landlord-tenant paperwork governs who can stay in a property, on what terms, and what happens when something goes wrong. Leases, notices to quit, security deposit demands, and habitability complaints all have state and often city-specific requirements for timing, content, and service. Getting the paperwork right is what makes an eviction actually succeed or a security deposit actually come back, because judges regularly dismiss cases over small procedural mistakes.
