ARKANSAS SECURITY DEPOSIT RULES
Pursuant to Ark. Code Ann. Section 18-16-301 et seq., the following rules apply to security deposits in Arkansas:
Maximum Security Deposit Amount
Under Ark. Code Ann. Section 18-16-304, a landlord covered by the residential security-deposit subchapter may not demand or receive a security deposit exceeding two (2) months' periodic rent. Section 18-16-303 exempts dwelling units owned by an individual when the individual, spouse, minor children, and described affiliated entities collectively own five or fewer dwelling units. The exemption does not apply to units for which third persons perform management, including rent collection, for a fee.
Return of Security Deposit
Under Ark. Code Ann. Section 18-16-305(a)(1), property or money held as security must be returned within sixty (60) days after termination of the tenancy. If the landlord applies money to accrued unpaid rent or damages, subsection (a)(2) requires the itemized notice and remainder within sixty (60) days after termination of the tenancy and delivery of possession by the tenant.
Permissible Deductions
The landlord may deduct from the security deposit:
- Accrued unpaid rent
- Damages suffered by reason of the tenant's noncompliance with the rental agreement
Written Itemized Statement
If deductions are made, the landlord must provide a written itemized statement of the accrued unpaid rent and damages applied, delivered with the remainder within the subsection (a)(2) period stated above.
Method of Delivery
The landlord complies with the return requirement by mailing via first class mail the written notice and any payment to the tenant's last known address.
Unclaimed Deposits
If the letter containing the payment is returned and the landlord cannot locate the tenant after reasonable effort, the payment becomes the property of the landlord 180 days from the date the payment was mailed.
Disclosure Requirements
Ark. Code Ann. Section 18-17-502(c)(1) provides a compliance safe harbor when the landlord supplies, when possession is available, a written form on which the tenant may list defects in the quality standards enumerated in subsection (a), and the tenant signs without noting a listed defect or fails to return the form within two business days. The statute does not describe this as a mandatory “known defects” disclosure.
Non-Refundable Deposits
Property or money held as security is subject to § 18-16-305 when the subchapter applies. Do not label a charge “non-refundable,” a fee, prepaid rent, or a deposit without counsel reviewing its real purpose and the statutory phrase “security deposit, however denominated.”

However, the money may be applied to the payment of accrued unpaid rent and any damages which the landlord has suffered by reason of the tenant's noncompliance with the rental agreement, all as itemized by the landlord in a written notice delivered to the tenant, together with the remainder of the amount due sixty (60) days after termination of the tenancy and delivery of possession by the tenant."
