ARKANSAS SECURITY DEPOSIT RULES
Pursuant to Ark. Code Ann. Section 18-16-301 et seq., the following rules apply to security deposits in Arkansas:
Maximum Security Deposit Amount
Under Ark. Code Ann. Section 18-16-304, landlords may not demand or receive a security deposit in an amount exceeding two (2) months' periodic rent. This limitation applies to landlords who:
- Own or manage six (6) or more dwelling units; OR
- Own five (5) or fewer units but hire a third party to manage the property
Return of Security Deposit
Under Ark. Code Ann. Section 18-16-305, the landlord must return the security deposit within sixty (60) days after termination of the tenancy and delivery of possession by the tenant.
Permissible Deductions
The landlord may deduct from the security deposit:
- Accrued unpaid rent
- Damages suffered by reason of the tenant's noncompliance with the rental agreement
- Costs to repair damage beyond ordinary wear and tear
- Cleaning costs necessary to restore the unit to move-in condition
Written Itemized Statement
If deductions are made, the landlord must provide a written itemized statement of all charges withheld, delivered to the tenant together with the remainder of the deposit within the 60-day period.
Method of Delivery
The landlord complies with the return requirement by mailing via first class mail the written notice and any payment to the tenant's last known address.
Unclaimed Deposits
If the letter containing the payment is returned and the landlord cannot locate the tenant after reasonable effort, the payment becomes the property of the landlord 180 days from the date the payment was mailed.
Disclosure Requirements
Under Ark. Code Ann. Section 18-17-502, if the landlord knows of any defects to the dwelling unit's heating and air conditioning, plumbing, roof, electricity, or drinking water systems, the landlord must disclose this information to the tenant at the time of move-in.
Non-Refundable Deposits
Non-refundable security deposits are prohibited under Arkansas law. All amounts collected as security must be refundable, subject to permissible deductions.
