Under Ala. Code § 35-9A-421(d), the landlord gives notice that the rental agreement will terminate seven days after this notice is received, on [TERMINATION DATE]. The landlord alleges the following noncurable default. Mark only a ground supported by the facts and complete its details.

☐ Illegal drugs — § 35-9A-421(d)(1). A tenant or occupant manufactured, cultivated, imported, transported, possessed, furnished, administered, or used illegal drugs in the dwelling unit or common areas. Person, conduct, place, and date: [SPECIFIC FACTS].

☐ Firearm or ammunition — § 35-9A-421(d)(2). A tenant or occupant illegally used, manufactured, imported, possessed, furnished, or discharged a firearm or ammunition on the rental property. Person, conduct, place, date, and why the statutory defense exceptions do not apply: [SPECIFIC FACTS].

☐ Substantially same breach — § 35-9A-421(d)(4). The landlord previously gave a notice to terminate for [DESCRIBE FIRST BREACH] on [DATE]; the tenant cured it. Within six months of that first breach, a tenant or occupant committed substantially the same acts or omissions on [DATE]: [SPECIFIC FACTS]. The prior notice and cure record are attached as [EXHIBIT].

☐ Third attempted cure in 12 months — § 35-9A-421(d). The tenant has already cured breaches of lease terms or obligations twice in the preceding 12 months: [FIRST BREACH, NOTICE, CURE DATES] and [SECOND BREACH, NOTICE, CURE DATES]. The present breach is [SPECIFIC ACTS, DATE, LEASE TERM]. The landlord has not expressly consented in writing to a further cure. Attach the earlier notices and cure records as [EXHIBITS].

Additional facts and supporting lease term, if applicable: [DETAILS OR ATTACHMENT]

The tenant has no right to cure the selected default unless the landlord consents. The landlord has not consented to a cure of this default. If possession is not surrendered after termination, the landlord may seek eviction through a court action.

Legal authority

  • Ala. Code § 35-9A-421(d) (noncurable defaults and seven-day termination notice)
  • Ala. Code § 35-9A-461(a) (court action for eviction)

Landlord-tenant paperwork governs who can stay in a property, on what terms, and what happens when something goes wrong. Leases, notices to quit, security deposit demands, and habitability complaints all have state and often city-specific requirements for timing, content, and service. Getting the paperwork right is what makes an eviction actually succeed or a security deposit actually come back, because judges regularly dismiss cases over small procedural mistakes.
