Nevada EFS — Electronic Filing and Service

  • Nevada's courts use electronic filing systems including Odyssey eFileNV (many districts) and eFlex (Eleventh Judicial District and others).
  • Attorneys in cases managed through the EFS must file documents electronically.
  • When a document is electronically submitted and filed, the EFS automatically sends notice to all registered users — this notice constitutes effective service. N.R.C.P. 5(b)(2)(E); NEFCR 9.
  • The time to respond is computed from the date of service stated in the proof of service, which must be the date of submission to the EFS.
  • Under N.R.C.P. 5(b)(4), a proof of service must be attached to an electronic filing.
  • Self-represented parties not registered with the EFS must be served by traditional non-electronic means.
  • Sealed documents: NEFCR 8 governs the filing of sealed documents — sealed records must be filed using the sealed document procedures; do not file sealed documents through the standard public filing queue.

Eighth Judicial District (Clark County — Las Vegas)

  • Clark County uses the Eighth Judicial District Court Rules, including Rule 9, which addresses additional certificate language and e-filing requirements.
  • Attorneys in Clark County (Eighth JD) must check Rule 9 and any current administrative orders for local certificate of service requirements.
  • File & ServeXpress has been used in Clark County for certain matters; confirm current EFS platform with the Eighth JD Clerk's Office.

Email Service Requirements — N.R.C.P. 5(b)(2)(D)

  • Email service in Nevada requires prior written consent of the party to be served, or a court order authorizing email service.
  • Email service is not automatic — it requires an affirmative consent mechanism.
  • Retain written consent documentation in the case file.

Service on Self-Represented (Pro Se) Parties

  • Self-represented parties who are not registered EFS users must be served by personal delivery, mail, overnight carrier, or other authorized non-electronic means.
  • Do not serve pro se parties through the EFS unless they are registered users.

Service of original process (summons and complaint, petition) must be made by personal service, substituted service, or service by publication as specified in N.R.C.P. 4. Original process, summons, and complaints cannot be served through the EFS or by email. N.R.C.P. 5(b)(2)(E) expressly excludes "a summons and complaint, petition, or other document that must be served with a summons" from EFS service. Service on a domestic corporation must be made on an officer, director, managing agent, or registered agent. NRS 14.020. Service by publication requires a court order. N.R.C.P. 4(e)(1).
