COLORADO 3-DAY RULE: Under C.R.C.P. 6(e) and C.R.C.P. 306(e), 3 additional days are added to a response period when service is made by mail or through the Colorado Courts E-filing system (CCE). This is distinctive — Colorado adds 3 days even for CCE electronic service.

SECTION 5: COLORADO COURTS E-FILING (CCE)

Colorado Courts E-Filing (CCE) is the Colorado Judicial Branch's statewide electronic filing and service system:

☐ All parties' counsel are registered CCE users — service was completed automatically upon e-filing
☐ Some parties are not registered CCE users — manual service was used for those parties (described above)
☐ This is a County Court matter; confirm CCE availability for that court

CCE Filing Confirmation:

  • CCE Transaction / Envelope No.: [________________________________]
  • Date/Time of Submission: [__/__/____] at [____:____] [AM/PM] MT
  • Filing Status: ☐ Accepted ☐ Submitted/Pending ☐ Rejected (describe: [________________])

CCE Service Mechanism:
When a document is filed through CCE, registered parties automatically receive an email notification with a link to the filed document. Under C.R.C.P. 306(e), a document transmitted through the e-System by 11:59 p.m. Colorado time is deemed served on that date, but entitles the served party to 3 additional days as provided under Rule 306(e).

Important: Unlike most states where e-filing service does not add extra time, Colorado adds 3 days to response periods even when service is made through the CCE electronic system.

SECTION 6: SELF-REPRESENTED PARTY SERVICE

(Complete if any party is self-represented and not registered in CCE.)

☐ A self-represented (pro se) party was served. Details:

Pro Se Party Name: [________________________________]
Mailing Address: [________________________________]
City, State, ZIP: [________________________________]
County: [________________________________]

Method:
☐ First-Class U.S. Mail — Deposited at [________________________________], Colorado on [__/__/____]
(3 additional days added to response period.)
☐ Certified Mail — Cert. No.: [________________________________]
☐ Hand Delivery — At [________________________________] on [__/__/____]
☐ Email — Email: [________________________________] (written consent provided on [__/__/____])

Note: Self-represented parties who are not registered in CCE should be served by mail unless they have agreed in writing to accept email service.

3 [________________________________] [____________] [________________________________] [____________] [__/__/____] [____________]
4 [________________________________] [____________] [________________________________] [____________] [__/__/____] [____________]
5 [________________________________] [____________] [________________________________] [____________] [__/__/____] [____________]

SECTION 8: DATE AND TIME OF SERVICE

Date of Service: [__/__/____]
Time of Service / Transmission: [____:____] [AM/PM] Mountain Time (MT — MST/MDT)
City/Location of Mailing or Delivery: [________________________________], Colorado

SECTION 9: COLORADO MAIL AND CCE 3-DAY RULE — TIME COMPUTATION

Colorado Time Extension Rules (C.R.C.P. 6(e) and 306(e)):

Method of Service Additional Days Notes
CCE e-filing (electronic portal) +3 calendar days C.R.C.P. 306(e) — unusual among states
Email (with written consent) +3 calendar days C.R.C.P. 6(e) — confirm with rule
First-Class U.S. Mail +3 calendar days C.R.C.P. 6(e)
Certified Mail +3 calendar days C.R.C.P. 6(e)
Hand / Personal Delivery 0 additional days Service complete upon delivery
Commercial Courier Verify per applicable rule

Colorado Distinctive Rule:
Most states exempt e-filing/e-service from mail-rule extensions. Colorado adds 3 days even for CCE e-service under Rule 306(e). This means that even when you file electronically and opposing counsel is automatically served, they get 3 extra days to respond. Plan your briefing schedules accordingly.

Calculation Example:

  • Motion filed via CCE on Monday, March 9
  • Standard response period: 21 days
  • Without extension: due March 30
  • With Colorado's 3-day CCE extension: due April 2

SECTION 10: DECLARATION

I affirm under penalty of perjury under the laws of the State of Colorado that the foregoing is true and correct.

Dated: [__/__/____]

Attorney for [________________________________] / Pro Se [Party]

SECTION 11: E-FILING INSTRUCTIONS (CCE)

How CCE Service Works:

  1. Attorney logs into the Colorado Courts E-Filing system at courts.state.co.us or through the CCE portal.
  2. Attorney creates a filing envelope, attaches documents, and identifies the parties to serve.
  3. CCE submits the filing to the court for review.
  4. Upon acceptance by the court, CCE sends email notification to all registered parties.
  5. The registered parties receive an email with a link to the filed document.
  6. For parties not registered in CCE, the filer must separately serve by mail, hand delivery, or email (with consent).
  7. Retain the CCE transaction number and service confirmation in the case file.

County Court Matters:
Not all Colorado county courts may be fully integrated with CCE. For county court matters, verify whether CCE is available and whether manual service is required.

SECTION 12: COUNTY-SPECIFIC NOTES

Denver County (2nd Judicial District):
Denver District Court has electronic filing requirements for most civil matters. Check for standing orders in the assigned division. The Denver Probate Court and Denver County Court have specific procedures.

Arapahoe County (18th Judicial District):
Standard CCE procedures apply. Check for local standing orders.

Jefferson County (1st Judicial District):
Standard CCE procedures apply. Verify local rules for family and domestic matters.

El Paso County (4th Judicial District):
El Paso County (Colorado Springs) uses CCE. Verify local rules.

Boulder County (20th Judicial District):
Standard CCE procedures. Check for local standing orders.

All Districts:
C.R.C.P. 5.2 requires redaction of personal information (social security numbers, financial account numbers, home addresses of private individuals) from court filings. Ensure the certificate of service does not expose protected information.

SECTION 13: PRACTITIONER NOTES

3-Day CCE Extension — A Common Trap:
Many Colorado practitioners forget that CCE e-service triggers the 3-day extension under Rule 306(e). Unlike in most states, electronic service in Colorado adds time for the served party to respond. When negotiating scheduling orders or stipulated extensions, factor in the CCE 3-day extension.

Email Service — Written Consent Required:
C.R.C.P. 5(b)(2)(E) permits email service only when the recipient has consented in writing. Obtain consent at the outset of litigation. If consent is obtained, the 3-day extension may or may not apply — confirm with current rules and case law.

CCE vs. Email Service:
Service through the CCE portal is the preferred method as it creates an automatic record. Email service requires maintaining separate proof of consent and transmission.

Redaction Requirements:
Under C.R.C.P. 5.2, filers must redact: (1) social security numbers; (2) financial account numbers; (3) names of minor children; (4) home addresses of witnesses and private individuals (use business address instead); and (5) other personal identification numbers. Comply with these requirements in all filings.

Record Keeping:
Maintain CCE confirmation emails, transaction IDs, and any manual service records in the litigation file consistent with Colorado Rule of Professional Conduct 1.15.

About This Template

These are the filings that drive a lawsuit through the system: complaints, answers, motions, briefs, discovery requests and responses, and post-judgment papers. Each has its own format requirements under federal and state procedural rules, and each has a deadline that cannot be missed without consequences. Clean, procedurally correct filings move a case forward; sloppy ones invite motions to strike, amended responses, and avoidable delays.

Important Notice

This template is provided for informational purposes. It is not legal advice. We recommend having an attorney review any legal document before signing, especially for high-value or complex matters.
