5.1 Court-Annexed Nonbinding Arbitration

Current NRS 38.250(1)(a) applies, subject to NRS 38.310, to a civil action filed in district court for damages where the cause of action arises in Nevada and the amount in issue does not exceed $100,000 per plaintiff, exclusive of attorney's fees, interest, and court costs, unless the action is routed to an alternative method described in the statute.

Do not mark arbitration applicable merely because the total case value is below $100,000; the statute uses the amount per plaintiff and includes the other stated conditions.

If the pleading files an action for professional negligence in district court, NRS 41A.071 directs dismissal without prejudice if the action is filed without an affidavit that satisfies all four statutory requirements.
