XVIII. PRACTICE TIPS AND GUIDANCE
Jurisdiction and Venue
- Subject Matter Jurisdiction: Nevada District Courts have general jurisdiction over civil actions with no minimum amount in controversy. Justice Courts have jurisdiction over matters not exceeding $15,000 (NRS 4.370).
- Venue: Venue is proper in the county where the defendant resides, where the cause of action arose, or where the property at issue is located (NRS 13.010 et seq.).
- Transfer: If venue is improper, the defendant may move to transfer under NRS 13.050. Transfer between departments within the same district does not affect venue.
Service of Process
- Time Limit: Under NRCP 4(e), a summons must be served within 120 days of filing the complaint. Failure to serve within that period may result in dismissal without prejudice.
- Waiver of Service: NRCP 4(d) permits a request for waiver of service, which extends the time to respond to 60 days from the date the request was sent.
- Service on Entities: Service on a corporation, LLC, or other entity registered in Nevada may be made through the Nevada Secretary of State (NRS 14.020) if the registered agent cannot be found.
Special Filing Requirements
- Medical Malpractice: For medical malpractice actions, an affidavit of merit by a medical expert must accompany the complaint (NRS 41A.071). Failure to attach the affidavit is grounds for dismissal.
- Construction Defect: Construction defect claims under NRS Chapter 40 require compliance with pre-litigation notice and opportunity-to-repair procedures before filing suit.
- Business Court: In Clark and Washoe Counties, complex commercial cases may be routed to the Business Court. Filing parties should review EDCR 2.20 for eligibility criteria and any supplemental filing requirements.
