Automatic stay
Section 362's automatic stay suspended claims against the bankruptcy petitioner and its wholly owned subsidiary, so the subsidiary's summary judgment motion was denied with leave to renew.
SGS Acquisition Co. v. Linsley · filed 2018-09-30
As a result, claims against it and its wholly owned subsidiary, Northern Zinc, are subject to the automatic stay put in place pursuant to 11 U.S.C. § 362. ... Section 362(a)(1) prevents judicial action “against the debtor” during the pendency of a bankruptcy proceeding. Censo’s argument under § 362(a)(3), which bars “any act to obtain possession . . . or to exercise control over property of the estate,” also fails. The district court’s decision that KAH took title subject to Fannie Mae’s deed of trust, did not “disturb the status quo of estate property as of the time when the bankruptcy petition was filed.” ... Section 362(a)(7) bars retaining postpetition proceeds to offset a prepetition overpayment; relief from the stay must be sought under § 362(d)-(g).
First National Bank of Louisville v. Hurricane Elkhorn Coal Corp. (In Re Hurricane Elkhorn Coal Corp.) · filed 1983-09-01(a)(7)
Finally, it can hardly be doubted that L & K’s retention of the contested amount violated the Bankruptcy Code’s automatic stay provisions, 11 U.S.C. § 362(a)(7). It may be possible for L & K to obtain relief from these stay provisions, but L & K must follow the procedures outlined by the Act, 11 U.S.C. § 362(d)-(g).Read the full opinion on CourtListener →
Relief from stay for post-confirmation defaults
Section 362(d)(1) permits relief from the automatic stay for post-confirmation payment defaults when relief is consistent with the confirmed Chapter 13 plan.
In Re Binder · filed 1998-08-28(d)(1)
Granting a creditor relief from the automatic stay for post-confirmation defaults is not precluded by any Code provision and is not inconsistent with § 1327 so long as such relief is consistent with the provisions of the confirmed plan. ... Breathing spell and regulatory proceedings
Section 362(a)’s breathing spell does not justify enjoining a rate-making proceeding when no party claims the automatic stay applies to it.
Louisiana Public Service Commission v. Mabey (In re Cajun Electric Power Cooperative, Inc.) · filed 1999-08-16(a)
Because appellees do not argue that the rate-making proceeding at issue in this appeal falls within the automatic stay provided by § 362(b)(4), the injunction cannot properly rest on the “breathing spell” afforded by § 362(a).Read the full opinion on CourtListener →
Applicability to ancillary proceedings
Section 362’s automatic stay does not apply in an ancillary proceeding under § 304, so a motion for relief from that stay is inappropriate.
Aranha v. Eagle Fund, Ltd. (In Re Thornhill Global Deposit Fund, Ltd.) · filed 2000-02-01(d)
Thus, for example, the debtor is not entitled to the automatic stay under § 362 or a discharge of its debts on completion of the section 304 proceeding. ... A motion for relief from stay is therefore inappropriate under this section.Read the full opinion on CourtListener →
Contempt as a remedy
Contempt is not a remedy for violating Section 362(a)’s automatic stay because the stay arises by statute rather than court order.
James v. Planters Bank (In Re James) · filed 2001-01-24(a)
Since the stay is a statutory provision and not a court order, contempt is no longer an appropriate remedy.Read the full opinion on CourtListener →
Utility service and the automatic stay
Section 362 does not make a utility’s refusal to restore service a stay violation when the utility takes no action to collect a prepetition debt; the stay-violation damages remedy is therefore unavailable.
One Stop Realtour Place, Inc. v. Allegiance Telecom, Inc. (In Re One Stop Realtour Place, Inc.) · filed 2001-10-17(a)(1), (a)(6), (h)
One Stop did not present any evidence that Allegiance took any action after the filing of the chapter 11 petition to collect the pre-petition debt or that Allegiance took any other action prohibited by Section 362(a)(1) or (6). Instead, the evidence presented by One Stop shows that Allegiance refused to restore service without a deposit or advance payment in violation of Section 366.Read the full opinion on CourtListener →
Presentment of negotiable instruments
Section 362(b)(11) permits a holder of a negotiable instrument to present it for payment without violating the automatic stay.
In re: Janice B. Meadows v. · filed 2008-11-12(b)(11)
It would be illogical to interpret § 362(b)(11) to mean that the holder of a check can hand the check to a bank teller but cannot take the cash the teller hands over the counter without violating the stay, or that the holder may accept the funds but must immediately return them to the drawer. Such an interpretation would render the exception essentially meaningless, because the purpose of presenting a check is to receive payment.Read the full opinion on CourtListener →
Interest in property
Section 362(b)(3) uses “interest in property” as a federal term informed by local property law.
Soto-Rios v. Banco Popular De Puerto Rico · filed 2011-11-23(b)(3)
We emphasize, however, that "interest in property" under sections 362(b)(3) and 546(b)(1)(A) is a federal statutory term, and "the meaning of [language under the Bankruptcy Code] is a matter of federal law".Read the full opinion on CourtListener →

Lien perfection exception
Section 362(b)(3) does not except passive retention of a debtor's vehicle to maintain a purported possessory lien from the automatic stay.
Cross v. City of Chi. (In re Cross) · filed 2018-05-25(b)(3)
The City is clearly incorrect that its actions are excepted from the automatic stay pursuant to 11 U.S.C. § 362(b)(3) both because the mere "act" of retaining possession of the vehicle in order to maintain perfection of its purported possessory lien is not excepted from the stay pursuant to that provision of the bankruptcy code and because it does not have a valid possessory lien pursuant to Illinois law.Read the full opinion on CourtListener →
Section 362(b)(3)'s lien-perfection exception does not permit a creditor to retain a debtor's car when the creditor's lien is not subject to avoidance by a trustee.
In re Shannon · filed 2018-09-07(b)(3)
Thus, a trustee could not use any avoiding powers under § 544 to avoid the City's possessory lien. Since there are no avoiding powers of the trustee under § 544 that would be limited by - or "subject to" - the City's ordinances, the exception to the automatic stay in § 362(b)(3) does not apply.Read the full opinion on CourtListener →
