2.3 Applicable Summary Judgment Standard
- Under Wyo. R. Civ. P. 56(a), summary judgment shall be granted when “the movant shows that there is no genuine dispute as to any material fact and the movant is entitled to judgment as a matter of law.”
- The non-movant must, under Rule 56(c), “set forth specific facts showing that there is a genuine issue for trial” and may not rely on mere allegations or denials.
- Affidavits or declarations supporting or opposing the motion must “be made on personal knowledge, set out facts that would be admissible in evidence, and show that the affiant or declarant is competent to testify on the matters stated.” Wyo. R. Civ. P. 56(c)(4).
