1. MOTION

2. STATEMENT OF UNDISPUTED MATERIAL FACTS (“SUMF”)

Pursuant to R.I. Super. Ct. R. Civ. P. 56(c), Defendant submits the following facts, each of which is undisputed and material:

III. Standard of Review
