XIV. ENFORCEMENT DEADLINES

CRITICAL: Under Idaho Code § 45-510, this lien shall cease to exist at the expiration of SIX (6) MONTHS after the Claim of Lien has been filed, unless an action to enforce the lien is commenced in the proper court within that time, or unless a credit is given and stated in the claim, in which case the lien ceases at the expiration of six months after the expiration of the credit.

XV. LIEN RELEASE AND BONDING PROVISIONS

A. Release of Lien

Upon full payment of the amount claimed, together with any accrued interest, costs, and attorney's fees, Claimant shall execute and record a Release of Lien with the County Recorder where this Claim of Lien was filed.

B. Bond to Discharge Lien (Idaho Code § 45-525)

The owner or any interested party may petition the court to release this lien by posting a surety bond in an amount equal to one and one-half (1.5) times the amount of the lien claimed (or such other amount as the court may order). The bond must be issued by a surety company authorized to transact business in Idaho.

C. Partial Release

If partial payment is received, Claimant may record a Partial Release of Lien reducing the amount claimed.


XVI. PRIORITY OF LIEN

Under Idaho Code § 45-506, the lien relates back to the date of commencement of the work of improvement. The lien has priority over any lien, mortgage, or other encumbrance that attached to the land after the commencement of the work of improvement.


XVII. ADDITIONAL NOTICES AND DISCLOSURES

  1. Residential Disclosure Requirement: For owner-occupied residential properties (four or fewer units), Idaho Code § 45-521 requires that a preliminary notice with specific statutory disclosures be provided to the owner before lien rights may be claimed.
