NEW YORK SECURITY DEPOSIT RULES (SUMMARY)
- Deposit return and itemization: Provide an itemized statement of any deductions and return the balance within 14 days after the tenant vacates.
- Forfeiture risk: Failure to provide the itemized statement within the 14-day period may forfeit the right to retain any portion of the deposit.
- Permissible deductions: Unpaid rent and damages beyond ordinary wear and tear; cleaning only to return the unit to the same condition as at move-in, excluding ordinary wear.
- Interest on deposits: For buildings with six or more units, follow New York interest-on-security-deposit requirements, including any permitted administrative retention.
