WYOMING SERVICE RULES — QUICK REFERENCE

Primary Authority: Wyoming Rules of Civil Procedure Rules 5 and 6 (W.R.C.P. 5, 6) and the Wyoming Rules for Electronic Filing and Service in District Courts govern service of papers after the initial process in Wyoming civil actions.

Who Must Be Served (W.R.C.P. 5(a)): Every pleading subsequent to the original complaint unless the court orders otherwise; every paper relating to discovery required to be served; every written motion (except one which may be heard ex parte); and every written notice, appearance, demand, offer of judgment, and similar paper must be served on each party. Service on a represented party is made upon their attorney.

Authorized Methods of Service (W.R.C.P. 5(b)):

  • Personal delivery: Delivering a copy to the attorney or party in person
  • Office delivery: Leaving at the attorney's office with a clerk or other person in charge; if the office is closed or the person has no office, leaving at the dwelling house or usual place of abode with a person of suitable age and discretion
  • Mail: Mailing a copy to the attorney's or party's last known address; complete upon mailing
  • Commercial delivery service: Leaving with a commercial carrier for delivery to the last known address
  • Electronic means: By consent in writing of the person served, including email or fax; or through the Wyoming e-filing system for registered participants
  • Email filing to the court: Email may be used to file documents with the court; must be virus-free; each email may contain documents for only one case; the case number must be in the subject line

Mail Service — Three-Day Extension (W.R.C.P. 6(d)): When any period of time to act is prescribed after service of a paper, and service is by mail, three (3) additional days are added to the prescribed period. No extension applies to electronic service.

Wyoming E-Filing System: The Wyoming Supreme Court has established and upgraded a statewide electronic filing system for district courts. The Wyoming Rules for Electronic Filing and Service in District Courts govern the use of the system. Additionally, File & ServeXpress (fileandservexpress.com) has been used as a service provider for certain Wyoming court e-filing. Attorneys should check the current Wyoming Courts website (wyocourts.gov) for the active e-filing portal and registration requirements.

Electronic Filing by Email: Email filing is authorized in Wyoming. When filing by email: (1) the email and attached documents must be virus-free; (2) no email shall contain pleadings for more than one case; (3) the case number must appear in the email subject line. Email filing serves as certification that the documents are virus-free.

Certificate of Service: W.R.C.P. 5(d) requires that papers required to be served be filed with the court together with a certificate of service showing the date, manner, and address or email of service.

Service on Self-Represented Parties: Self-represented parties who are not registered with the Wyoming e-filing system and have not consented to electronic service must be served by traditional methods (mail, personal delivery, or other authorized means under W.R.C.P. 5(b)).

Wyoming Circuit Courts: Wyoming also has circuit courts with their own civil procedure rules. The Wyoming Rules of Civil Procedure for Circuit Courts govern proceedings in circuit court. Confirm which set of rules applies to the specific court.
