Key Wyoming Practice Points
-
Uniform Rule 102 — Appearance and Withdrawal: Uniform Rule 102 for District Courts governs attorney appearances and withdrawals. An attorney enters an appearance by filing a notice of appearance, by filing a pleading on behalf of a party, or by appearing at a hearing and being noted on the record. Withdrawal requires leave of court under W.R.C.P. Rule 11(b).
-
Scheduling Orders: Wyoming district courts typically issue scheduling orders shortly after all parties have appeared. The scheduling order sets deadlines for discovery, motions, pretrial conferences, and trial. Monitor the docket for scheduling orders and comply with all deadlines.
-
Initial Case Management: Some judicial districts require an initial case management conference after appearances are entered. The parties may be required to submit a joint case management report or proposed scheduling order. Check the assigned judge's practices.
-
Responsive Pleading Deadlines: Under W.R.C.P. Rule 12(a), a responsive pleading must be served within 20 days after service of the summons and complaint (or 30 days if the State of Wyoming is a party). Entering an appearance does not change this deadline.
-
Withdrawal of Counsel: Under Uniform Rule 102 and W.R.C.P. Rule 11(b), an attorney may not withdraw without leave of court. The motion to withdraw must: (a) state the reason for withdrawal; (b) certify that the client has been notified; (c) provide the client's last known address; and (d) state whether any hearings or deadlines are pending.
-
Oil, Gas, and Mineral Litigation: Wyoming has significant natural resources litigation. Cases involving oil and gas, mineral rights, and water rights may have specialized procedural requirements and may be heard by judges with particular expertise. Check for any special rules or practices.
-
Water Rights Adjudication: Water rights cases in Wyoming may involve the Board of Control and specialized procedures under Wyo. Stat. Ann. § 41-4-501 et seq. These cases may have unique appearance and filing requirements.
-
Small Bar Considerations: Wyoming has a relatively small bar. Professional courtesy is highly valued, and attorneys are expected to cooperate in scheduling and to comply with discovery obligations without unnecessary motion practice.
-
Chancery Court: Wyoming established a Chancery Court in 2024 with jurisdiction over business entity disputes. The W.R.C.P. apply to Chancery Court proceedings. If the case is assigned to the Chancery Court, verify any specialized filing procedures.
-
Circuit Court Appeals: If the matter involves an appeal from circuit court (court of limited jurisdiction), the notice of appearance should reference both the circuit court case number and the district court appeal number.
Common Mistakes to Avoid
- Not registering for the new e-filing system (all users need new accounts after the system upgrade)
- Using outdated system URLs for e-filing
- Omitting the Wyoming State Bar number from the filing
- Filing in the wrong county or judicial district
- Not checking the assigned judge's scheduling practices
- Failing to comply with Uniform Rule 102 requirements for withdrawal
- Not serving all parties of record at the time of filing

About This Template
These are the filings that drive a lawsuit through the system: complaints, answers, motions, briefs, discovery requests and responses, and post-judgment papers. Each has its own format requirements under federal and state procedural rules, and each has a deadline that cannot be missed without consequences. Clean, procedurally correct filings move a case forward; sloppy ones invite motions to strike, amended responses, and avoidable delays.
Important Notice
This template is provided for informational purposes. It is not legal advice. We recommend having an attorney review any legal document before signing, especially for high-value or complex matters.
