TEXAS SERVICE RULES — QUICK REFERENCE
Primary Authority: Texas Rules of Civil Procedure 21 and 21a govern filing and service of pleadings, motions, and all other papers in Texas civil proceedings.
Mandatory Electronic Filing (Tex. R. Civ. P. 21(f)): Attorneys must electronically file all documents in courts that have mandated e-filing through eFileTexas.gov (operated by Tyler Technologies), except in juvenile cases (Title 3, Family Code) and truancy cases (Title 3A, Family Code). Virtually all Texas district courts and county-level courts have mandated e-filing. Self-represented parties may, but are not required to, file electronically.
eFileTexas.gov — The Texas E-Filing System: Attorneys file documents through an Electronic Filing Service Provider (EFSP) that connects to the statewide Electronic Filing Manager (EFM). The Texas Supreme Court and Court of Criminal Appeals have approved multiple EFSPs. The EFSP transmits the filing and service information through the EFM to all registered parties' EFSPs.
Automatic Electronic Service (Tex. R. Civ. P. 21(f)(2)): When a document is filed electronically through eFileTexas, the EFM must serve it electronically upon all parties whose email addresses are registered with the EFM. Electronic service is complete upon transmission of the document to the serving party's EFSP. The EFM sends confirmation of service. An automated service record is generated; however, confirm whether local court rules require a separate written certificate of service.
Certification Requirement (Tex. R. Civ. P. 21(a)): The party or attorney must certify compliance with the service rules in writing over their signature on the filed document. A certificate by a party or attorney of record constitutes prima facie evidence of the fact of service.
Authorized Methods of Service (Tex. R. Civ. P. 21a(a)):
- Delivering in person or by agent
- Mailing to the address on file or last known address by U.S. mail or certified mail
- Delivering by commercial delivery service (same-day or next-day)
- Fax — if the party has filed an answer or appearance designating a fax number
- Email — if the party has an email address registered with the EFM, or otherwise consents in writing; or by any other electronic transmission consented to in writing
- Electronic service through the electronic filing manager (eFileTexas)
Mail Service — Three-Day Extension (Tex. R. Civ. P. 21a(c)): When service is made by mail, three (3) additional days are added to any response or action period computed from the date of service. No extension applies to electronic service or personal delivery.
Email Address on All Electronically Filed Documents: The email address of the attorney or self-represented party must be included on all documents electronically filed. Tex. R. Civ. P. 21(f)(1).
Unrepresented Parties: A self-represented party who is not registered with eFileTexas may be served by mail, personal delivery, or other methods in Tex. R. Civ. P. 21a(a).
