NEW HAMPSHIRE PRACTICE NOTES
(Guidance for practitioners -- review and remove before filing.)
Electronic Filing and Service Systems
-
Odyssey File & Serve: The New Hampshire Judicial Branch uses the Tyler Technologies Odyssey File & Serve platform for electronic filing and service in Superior Court and Circuit Court. Attorneys are required to file electronically. Self-represented parties may file electronically or by paper. Access: https://newhampshire.tylertech.cloud/ofsweb.
-
TurboCourt: The TurboCourt platform is available for initiating new cases and filing certain documents, particularly in Circuit Court. It is commonly used by self-represented parties. Access: https://turbocourt.com.
-
Electronic Service Satisfies Rule 5 Requirements: Under N.H. Super. Ct. Supplemental E-Filing Rule 13, electronic service through the Odyssey File & Serve system satisfies the requirement to serve copies of all pleadings and communications on all other counsel and self-represented parties who are registered e-filers. The system generates an automatic confirmation of service.
-
Formal Service Exception: Documents requiring personal service or other formal service of process to confer jurisdiction (e.g., original complaints, summonses, subpoenas, petitions initiating a case) must NOT be served electronically. See N.H. Super. Ct. Supplemental E-Filing Rule 12. These documents require service under RSA 510:2 or other applicable statutes.
-
Convenience Fee: As of September 2025, electronic court transactions conducted with a credit or debit card through Odyssey File & Serve or TurboCourt are subject to a 3% convenience fee.
Service Timing and Completion Rules
-
Service by Mail -- Three Additional Days: When service is made by first-class mail under Superior Court or Circuit Court rules, three (3) additional days are added to any applicable response deadline to account for mailing time. Verify the specific rule governing the response period.
-
When Service Is Complete:
- Mail: Service is complete upon mailing (deposit in the U.S. mail with postage prepaid).
- Electronic service: Service is complete upon electronic transmission, provided the system generates confirmation.
- Hand delivery: Service is complete upon delivery to the person or their agent.
- Certified mail: Service is complete upon mailing, though proof of receipt (return receipt) may be relevant to establishing actual notice. -
Weekends and Holidays: When a service deadline falls on a Saturday, Sunday, or New Hampshire legal holiday, service is timely if made on the next business day.
Redaction and Privacy Requirements
-
N.H. Super. Ct. R. 8 (Redaction): Before serving and filing documents, practitioners must comply with redaction requirements for personal identifying information, including Social Security numbers, financial account numbers, dates of birth of minors, and names of minors in certain case types. Failure to redact may result in sanctions.
-
RSA 91-A (Right-to-Know Law): Court records that are public under RSA 91-A may be accessed by third parties. Ensure that sensitive or confidential information is properly redacted or filed under seal where authorized.
Record Retention and Proof of Service
-
Retain All Proof of Service: Retain copies of all certificates of service, certified mail return receipts, delivery confirmations, Odyssey transaction confirmations, and courier tracking records for the case file. Proof of service may be required during compliance hearings, on motions challenging service, or on appeal.
-
Filing the Certificate: The Certificate of Service should be filed with the court as part of the document being served (typically as the final page) or as a separate filing immediately following the served document. In e-filing systems, it is generally included as the last page of the filed document.
Special Situations
-
Self-Represented Parties: Parties who are not registered for electronic filing must be served by conventional means (first-class mail, hand delivery, certified mail, etc.) unless they have provided written consent to accept service by email.
-
Multiple Methods: If serving the same party by more than one method (e.g., both email and first-class mail), check all applicable methods on the Certificate of Service and state the reason if relevant (e.g., "email sent as a courtesy copy; first-class mail sent as the official method of service").
-
Administrative Orders: Verify current Superior Court Administrative Orders for any additional or modified service requirements, particularly in complex litigation, class actions, domestic violence cases, or emergency proceedings.
-
Service on Government Entities: When serving documents on the State of New Hampshire, a municipality, or a government agency, consult RSA 510:4 and applicable rules regarding service on the Attorney General, town counsel, or designated agent.

About This Template
These are the filings that drive a lawsuit through the system: complaints, answers, motions, briefs, discovery requests and responses, and post-judgment papers. Each has its own format requirements under federal and state procedural rules, and each has a deadline that cannot be missed without consequences. Clean, procedurally correct filings move a case forward; sloppy ones invite motions to strike, amended responses, and avoidable delays.
Important Notice
This template is provided for informational purposes. It is not legal advice. We recommend having an attorney review any legal document before signing, especially for high-value or complex matters.
