XVI. PRACTICE TIPS FOR NEW HAMPSHIRE CIVIL FILINGS

Venue: Superior Court venue is proper in the county where the plaintiff or defendant resides or where the cause of action arose (RSA 507:9).

Statutes of Limitation: The general statute of limitations for personal injury in New Hampshire is three years (RSA 508:4). For breach of contract, six years for written agreements (RSA 508:4). Medical malpractice actions must be brought within three years of discovery (RSA 507-C:4).

Medical Malpractice Screening: Under RSA 507-E, a medical malpractice action requires a certificate of good faith from a medical expert before or shortly after filing. A mandatory pre-litigation screening panel may apply.

Right-to-Know Appeals: Administrative appeals under RSA 91-A (Right-to-Know Law) are filed in the Superior Court and follow expedited procedures.

ADR Requirements: Under N.H. Superior Court Rule 32, the court may order the parties to participate in alternative dispute resolution, including mediation or neutral evaluation.

Automatic Discovery: Under N.H. Superior Court Rules 21–28, certain initial disclosures are required early in the case. Review these rules carefully before the initial case management conference.

Confidential Information: Do not include Social Security numbers, financial account numbers, or dates of birth of minors in public filings. Use the Confidential Information Form if such information must be submitted to the court.

Case Management Conference: Expect the court to schedule an initial case management conference early in the case. Review Superior Court Rule 7 and come prepared with a proposed scheduling order.
